The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:30 a.m., in room 505, Victoria Building, the joint chairs, the Honourable Joseph A. Day and Harold Albrecht, presiding.

Representing the Senate: The Honourable Senator Day (1).

Representing the House of Commons: Harold Albrecht, Vance Badawey, Bob Benzen, Pierre-Luc Dusseault, Fayçal El-Khoury, James Maloney, Larry Miller, Ramesh Sangha, Francis Scarpaleggia, Martin Shields, Scott Simms and Geng Tan (12).

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The joint chairs made a statement.

In the matter of Maintenance Dredging Services Tonnage Fees (U1998-2), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Fisheries and Oceans with respect to certain comments made by the committee.

In the matter of SOR/2014-198, Firearms Records Regulations (Classification), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2015-212, Regulations Amending the National Energy Board Act Part VI (Oil and Gas) Regulations, it was agreed that the joint chairs correspond with the Minister of Natural Resources with respect to certain comments made by the committee.

In the matter of SOR/2017-217, Regulations Amending the Regulations Designating Regulatory Provisions for Purposes of Enforcement (Canadian Environmental Protection Act, 1999), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of the Environment with respect to certain comments made by the committee.

In the matter of SOR/2014-149, Regulations Amending the Coastal Fisheries Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Fisheries and Oceans with respect to certain comments made by the committee.

In the matter of SOR/2007-137, Assisted Human Reproduction (Section 8 Consent) Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2017-110, Regulations Amending Certain Regulations Made Under Sections 140, 209 and 286.1 of the Canadian Environmental Protection Act, 1999, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of the Environment with respect to certain comments made by the committee.

In the matter of SOR/2011-83, Regulations Amending the Licensed Dealers for Controlled Drugs and Narcotics Fees Regulations (1056), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Health with respect to certain comments made by the committee.

In the matter of SOR/2012-135, Regulations Amending the Sulphur in Diesel Fuel Regulations, it was agreed that the file be closed.

In the matter of the Fee Schedule: Fees to be paid for marine navigation services provided by the Canadian Coast Guard (U2012-1) and the Amendments to the Fee Schedule: Fees to be paid for marine navigation services provided by the Canadian Coast Guard (U2012-4), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Fisheries and Oceans with respect to certain comments made by the committee.

In the matter of SOR/2018-123, Order 2018-87-03-01 Amending the Domestic Substances List, it was agreed that the file be closed.

In the matter of SOR/2012-160, General Export Permit No. 45 — Cryptography for the Development or Production of a Product, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Foreign Affairs, Trade and Development with respect to certain comments made by the committee.

In the matter of the Fee schedule for Icebreaking Services (1998) (U1998-3) and the Amendments to the Fee schedule: Fees to be paid for icebreaking services provided by the Canadian Coast Guard (U2012-3), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Fisheries and Oceans with respect to certain comments made by the committee.
