The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:32 a.m., in room 256-S, Centre Block, the joint chairs, the Honourable Joseph A. Day and Mr. Harold Albrecht, presiding.
Representing the Senate: The Honourable Senators Day, Dean and Mégie (3).
Representing the House of Commons: Harold Albrecht, Bob Benzen, Pierre-Luc Dusseault, Jim Eglinski, Ali Ehsassi, Fayçal El-Khoury, Churence Rogers, Sherry Romanado, Francis Scarpaleggia, Martin Shields, Jati Sidhu and Borys Wrzesnewskyi (12).
In attendance: Justin Vaive, Joint Clerk of the Committee (House of Commons), Cynthia Kirkby, Acting General Counsel and Penny Becklumb, Counsel, Parliamentary Information and Research Service, Library of Parliament.
Also in attendance: The official reporters of the Senate.
The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
Mr. El-Khoury proposed:
That the committee meet in camera and that, notwithstanding usual practice, committee members' assistants be allowed to remain in the room;
That the committee allow the transcription of the in-camera portion of today's meeting, and that the general counsel keep a copy in her office for consultation by committee members.
The question being put on the motion, it was adopted.
At 8:32 a.m., the committee suspended.
At 8:33 a.m., the committee resumed in camera.
By unanimous consent, it was agreed that the Standing Joint Committee for the Scrutiny of Regulations would appoint Cynthia Kirkby as acting general counsel of the joint committee in accordance with the terms and conditions agreed to between the joint committee and the Library of Parliament.
It was agreed:
That the practices and options proposed for the committee (SF2018-2) be adopted.
At 8:35 a.m., the committee suspended.
At 8:36 a.m., the committee resumed in public.
On SOR/2002-164 — National Capital Commission Animal Regulations and SOR/2002-165 — Regulations Amending the National Capital Commission Traffic and Property Regulations, it was agreed that the joint chairs invite the Minister of Canadian Heritage and Multiculturalism to appear before the committee.
On SOR/2009-324 — Regulations Amending the Esquimalt Graving Dock Regulations, 1989, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Public Services and Procurement and Accessibility with respect to certain comments made by the committee.
On the Terms and Conditions of Employment of the Federal Ombudsman for Victims of Crime (U2014-2), it was agreed that counsel for the committee correspond with the Designated Instruments Officer of the Department of Justice with respect to certain comments made by the committee.
On SI/2016-32 — Banff National Park of Canada Siksika Nation Castle Mountain Land and Timber Claim Settlement Agreement Rent and Fee Remission Order, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of the Environment and Climate Change with respect to certain comments made by the committee.
On SOR/2017-162 — United Nations Peacekeeping Defence Ministerial Conference (Vancouver 2017), it was agreed that the file be closed.
On SOR/2017-228 — Regulations Amending the Radiation Emitting Devices Regulations (Dental X-ray Equipment), it was agreed that the file be closed.
On SOR/94-753 — Indian Oil and Gas Regulations, 1995, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
On SOR/2017-21 — Regulations Amending Certain Parks Canada Agency Regulations (Miscellaneous Program), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
On SOR/2017-58 — Regulations Amending Certain Department of Fisheries and Oceans Regulations (Miscellaneous Program), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
On C.R.C. c. 1486 — Small Fishing Vessel Inspection Regulations, SOR/93-195 — Quebec Maple Syrup Producers' Levy (Interprovincial and Export Trade) Order, SOR/2013-219 — Regulations Amending Certain Regulations Imposing Sanctions on the Democratic People's Republic of Korea and SOR/2018-62 — Regulations Repealing the Telecommunications Apparatus Regulations (Miscellaneous Program), it was agreed that the file be closed.
