The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:30 a.m., in room 256-S, Centre Block, the joint chair, the Honourable Senator Joseph A. Day, presiding.

Representing the Senate: The Honourable Senators Campbell, Day and Mégie (3).

Representing the House of Commons: Vance Badawey, Bob Benzen, Pierre-Luc Dusseault, Ali Ehsassi, Fayçal El- Khoury, Francis Scarpaleggia, Larry Miller, Sherry Romanado, Ruby Sahota, Martin Shields and Geng Tan (11).

Also present: Marc-Olivier Girard, Joint Clerk of the Committee (House of Commons), Cynthia Kirkby, Acting General Counsel, and Penny Becklumb, Counsel, Parliamentary Information and Research Service, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee continued its study pursuant to its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

Aaron McCrorie, Acting Assistant Deputy Minister, Safety and Security;

Marcia George, Director, Aviation Safety Regulatory Review;

Ross Ezzeddin, Director General, Air and Marine Programs.

The joint chair made a statement.

Mr. McCrorie, Ms. George and Mr. Ezzeddin made statements and answered questions.

At 9:29 a.m., the committee suspended.

At 9:32 a.m., the committee resumed.

In the matter of SOR/2006-102 — Traffic on the Land Side of Airports Regulations, SOR/2007-229 — Regulations Amending the Canadian Aviation Regulations (Part IV), SOR/2009-90 — Regulations Amending the Canadian Aviation Regulations (Parts I, VI and VII) and SOR/2009-152 — Regulations Amending the Canadian Aviation Regulations (Parts I and VII), it was agreed that counsel to the committee correspond with the designated instruments officer at Transport Canada to share some of the committee's observations.

In the matter of SOR/2011-236 — Regulations Amending the Criminal Records Regulations, it was agreed that the joint chairs correspond with the Minister of Transport to share some of the committee's observations.

In the matter of SOR/78-830 — Wood Buffalo National Park Game Regulations, it was agreed that the joint chairs invite the Minister of Environment and Climate Change to appear before the committee.

In the matter of SOR/2014-48 — Regulations Amending the Letter Mail Regulations and SOR/2014-53 — Regulations Amending Certain Regulations Made Under the Canada Post Corporation Act, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2013-122 — Regulations Amending Certain Regulations Concerning Prescription Drugs (Repeal of Schedule F to the Food and Drug Regulations), it was agreed that the file be closed.

In the matter of SOR/2017-282 — Regulations Amending Schedules 2 to 4 to the Human Pathogens and Toxins Act, it was agreed that the file be closed.

In the matter of SOR/2016-326 — Regulations Amending the Canadian Egg Marketing Agency Quota Regulations, 1986, it was agreed that counsel to the committee review its status at a later date and inform the committee of the action taken.

In the matter of SOR/2013-254 — Regulations Amending the Canadian Broiler Hatching Egg and Chick Licensing Regulations, SOR/2013-255 — Regulations Amending the Canadian Broiler Hatching Egg and Chick Orderly Marketing Regulations, SOR/2013-256 — Regulations Amending the Canadian Broiler Hatching Egg (Interprovincial) Pricing Regulations, SOR/2016-290 — Regulations Amending the Canadian Broiler Hatching Egg (Interprovincial) Pricing Regulations, SOR/2016-291 — Regulations Amending the Canadian Broiler Hatching Egg and Chick Licensing Regulations, and SOR/2016-292 — Regulations Amending the Canadian Broiler Hatching Egg and Chick Orderly Marketing Regulations, it was agreed that the files be closed.

In the matter of SOR/2014-124 — Regulations Amending the Food and Drug Regulations (Data Protection — Miscellaneous Program), and SOR/2014-125 — Regulations Amending the Food and Drug Regulations (Retention of Records — Miscellaneous Program), it was agreed that the files be closed.

At 9:54 a.m., the committee adjourned to the call of the chair.
