The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:30 a.m., in room 256-S, Centre Block, the joint chairs, the Honourable Joseph A. Day and Harold Albrecht, presiding.

Representing the Senate: The Honourable Senators Day, Stewart Olsen and Woo (3).

Representing the House of Commons: Harold Albrecht, Vance Badawey, Bob Benzen, Nicola Di lorio, Kerry Diotte, Pierre-Luc Dusseault, Ali Ehsassi, Fayçal El-Khoury, John Oliver, Churence Rogers, Francis Scarpaleggia and Dave Van Kesteren (12).

In attendance: Christine Holke, Joint Clerk of the Committee (House of Commons), Evelyne Borkowski-Parent, General Counsel, and Penny Becklumb, Counsel, Parliamentary Information and Research Service, Library of Parliament.

Also present: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2004-109 — Regulations Amending the Pulp and Paper Effluent Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer in the Department of Environment and Climate Change with respect to certain comments by the committee.

In the matter of SOR/2008-222 — Wage Earner Protection Program Regulations, it was agreed that the joint chairs write to the Minister of Employment, Workforce Development and Labour with certain comments made by the committee.

In the matter of SOR/2016-126 — Regulations Amending the Migratory Birds Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer in the Department of Environment and Climate Change with respect to certain comments by the committee.

In the matter of SOR/2017-120 — Regulations Amending the Canada Pension Plan Regulations and Repealing the Canada Pension Plan (Social Insurance Numbers) Regulations, it was agreed that the file be closed.

In the matter of SOR/2017-153 — Order Amending the Schedule to the First Nations Elections Act (Pheasant Rump), it was agreed that the file be closed.

In the matter of Orders Made by Boards and Agencies under the Agricultural Products Marketing Act (SOR/2002- 309), it was agreed that counsel to the committee correspond with the Designated Instruments Officer in the Department of Agriculture and Agri-Food with respect to certain comments by the committee.

In the matter of SOR/2008-135 — Order Amending Schedule I to the Access to Information Act and SOR/2008-136 — Order Amending the Schedule to the Privacy Act, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

At 9:11 a.m., the committee suspended.

At 9:16 a.m., the committee resumed.

In the matter of C.R.C. c. 1486 — Small Fishing Vessel Inspection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer in the Department of Transport with respect to certain comments by the committee.

In the matter of SOR/96-423 — Patent Rules and SOR/2003-208 — Rules Amending the Patent Rules, it was agreed that a notice of disallowance be issued to the Minister of Innovation, Science and Economic Development.

In the matter of SOR/2007-229 — Regulations Amending the Canadian Aviation Regulations (Part IV), it was agreed that a notice of disallowance be issued to the Minister of Transport.

In the matter of SOR/2011-236 — Regulations Amending the Criminal Records Regulations, it was agreed that joint chairs correspond with the Minister of Public Safety with respect to certain comments by the committee.

In the matter of SOR/2013-117 — Regulations Amending Certain Regulations Made Under the Motor Vehicle Safety Act, it was agreed that counsel to the committee correspond with the Designated Instruments Officer in the Department of Transport with respect to certain comments by the committee.

In the matter of SOR/2007-15 — Export Permits Regulations (Softwood Lumber Products 2006) and SOR/2007-16 - Softwood Lumber Products Export Allocations Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2013-82 — Social Insurance Number Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2016-258 — Regulations Amending the Wage Earner Protection Program Regulations (Miscellaneous Program), SOR/2017-149 — Order 2017-87-05-01 Amending the Domestic Substances List SOR/2017- 150 — Order 2011-112-05.01 Amending the Domestic Substances List, it was agreed that the files be closed.

The committee considered the following statutory instruments without comment:

SOR/2017-80 — Order Amending Schedules I and IV to the Weights and Measures Act,

SOR/2017-146 — Order Authorizing the Issue of a One-dollar Circulation Coin Specifying the Characteristics and Determining the Design,

SOR/2017-151 — Order Amending the Indian Bands Council Elections Order (Sakimay),

SOR/2017-152 — Order Amending the Schedule to the First Nations Elections Act (Sakimay),

SOR/2017-155 — Order Amending the Indian Bands Council Elections Order (Onion Lake),

SOR/2017-164 — Order Amending the Indian Bands Council Elections Order (Halfway River) and

SOR/2017-170 — Regulations Specifying Territories and Indicating International Registers.
