The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:32 a.m., in room 256-S, Centre Block, the joint chair, Mr. Harold Albrecht, presiding.

Members of the committee present: The Honourable Senators Moore, Omidvar and Runciman (3).

Other senator present: The Honourable Senator Boniface (1).

Representing the House of Commons: Harold Albrecht, John Brassard, Nicola Di Iorio, Pierre-Luc Dusseault, Ali Ehsassi, Fayçal El-Khoury, Garnett Genuis, Bernadette Jordan, Larry Maguire, Marco Mendicino, Marwan Tabbara and Salma Zahid (12).

Also present: Jean-Marie David, Joint Clerk of the Committee (House of Commons), Evelyne Borkowski-Parent, General Counsel, and Shawn Abel, Counsel, Parliamentary Information and Research Service, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

Ms. Borkowski-Parent made a statement regarding the Farm Products Council of Canada.

The joint chairs made a statement.

In the matter of SOR/2002-309 — Agricultural Products Marketing Act Administrative Review, it was agreed that the joint chairs invite the Minister of Agriculture and Agri-Food Canada to appear before the committee and senior officials.

In the matter of SOR/92-620 — Corrections and Conditional Release Regulations; and SOR/96-108 — Corrections and Conditional Release Regulations, amendment, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Public Safety Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-124 — Bowie Seamount Marine Protected Area Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Fisheries and Oceans Canada with respect to certain comments made by the committee.

In the matter of SOR/2012-135 — Regulations Amending the Sulphur in Diesel Fuel Regulations, it was agreed that the joint chairs correspond with the Minister of Environment and Climate Change Canada with respect to certain comments made by the committee; it was also agreed that the joint chairs invite officials from Environment and Climate Change Canada to appear before the committee should satisfactory action not be taken.

In the matter of SOR/2013-84 — Regulations Amending the Canada Pension Plan (Social Insurance Numbers) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Employment and Social Development Canada with respect to certain comments made by the committee.

In the matter of SOR/94-276 — Canadian Forces Superannuation Regulations, amendment; and SOR/2008-307 — Regulations Amending the Canadian Forces Superannuation Regulations and the Reserve Force Pension Plan Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of National Defence and the Canadian Armed Forces with respect to certain comments made by the committee.

In the matter of SOR/2009-315 — Canada Oil and Gas Drilling and Production Regulations; SOR/2009-316 — Newfoundland Offshore Petroleum Drilling and Production Regulations; and SOR/2009-317 — Nova Scotia Offshore Petroleum Drilling and Production Regulations it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Natural Resources Canada with respect to certain comments made by the committee. It was also agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/96-188 — Interest and Administrative Charges Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Treasury Board of Canada Secretariat with respect to certain comments made by the committee.

In the matter of SOR/2011-136 — Regulations Amending the Great Lakes Pilotage Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee. It was also agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2013-202 — Emergency Order for the Protection of the Greater Sage-Grouse, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment and Climate Change Canada with respect to certain comments made by the committee. It was also agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2016-200 — Regulations Amending the Contraventions Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Department of Justice with respect to certain comments made by the committee. It was also agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SI/2016-18 — Transfer of Duties Order, it was agreed that the file be closed.

In the matter of SOR/2016-102 — Regulations Repealing the Cigarette Ignition Propensity Regulations; SOR/2016- 103 — Cigarette Ignition Propensity (Consumer Products) Regulations; and SOR/2016-105 — Regulations Amending the Tobacco Products Information Regulations (Miscellaneous Program), it was agreed that the file be closed.

In the matter of SOR/2016-208 — Emergency Order for the Protection of the Western Chorus Frog (Great Lakes/ St. Lawrence — Canadian Shield Population), it was agreed that the file be closed.

At 9:28 a.m., the committee adjourned to the call of the joint chairs.
