The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:30 a.m., in room 505, Victoria Building, the joint chairs, the Honourable Joseph A. Day and Mr. Harold Albrecht, presiding.

Representing the Senate: The Honourable Senators Day, Duncan and Mégie (3).

Representing the House of Commons: Harold Albrecht, Vance Badawey, Bob Benzen, Pierre-Luc Dusseault, Fayçal El-Khoury, James Maloney, Larry Miller, Churence Rogers, Ramesh Sangha, Francis Scarpaleggia, Martin Shields, and Geng Tan (12).

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/97-109 — PCB Waste Export Regulations, 1996; SOR/2002-301 — Interprovincial Movement of Hazardous Waste Regulations; SOR/2009-162 — Chromium Electroplating, Chromium Anodizing and Reverse Etching Regulations; SOR/2010-138 — Regulations Prescribing Circumstances for Granting Waivers Pursuant to Section 147 of the Act; and SOR/2011-261 — Regulations Amending the Off-Road Compression-Ignition Engine Emission Regulations, it was agreed that counsel to the committee would write to the designated instruments officer at the Department of Environment and Climate Change to share some of the committee's observations.

In the matter of SOR/92-620 — Corrections and Conditional Release Regulations; and SOR/96-108 — Corrections and Conditional Release Regulations — Amendment, it was agreed that the joint chairs would write to the Minister of Public Safety and Emergency Preparedness to share some of the committee's observations.

In the matter of SOR/2017-10 — Order Amending Schedule 1 to the Species at Risk Act; SOR/2017-59 — Order Amending Schedule 1 to the Species at Risk Act; SOR/2017-112 — Order Amending Schedule 1 to the Species at Risk Act; SOR/2017-229 — Order Amending Schedule 1 to the Species at Risk Act; SOR/2018-10 — Order Amending Schedule 1 to the Species at Risk Act; and SOR/2016-281 — Critical Habitat of the Roseate Tern (Sterna dougallii) Order, it was agreed that the joint chairs would write to the Minister of Environment and Climate Change to share some of the committee's observations.

In the matter of SOR/2001-34 — Regulations Amending the Export Permits Regulations; and SOR/2003-216 — Regulations Amending the Export Permits Regulations, it was agreed that the joint chairs would write to the Minister of Foreign Affairs to share some of the committee's observations.

In the matter of SOR/2015-195 — Regulations Amending the Firearms Marking Regulations; and SOR/2017-88 — Regulations Amending the Firearms Marking Regulations, it was agreed that the files be closed.

In the matter of SOR/2013-115 — Regulations Amending the Privacy Regulations, it was agreed that counsel to the committee would write to the designated instruments officer at the Department of Justice to share some of the committee's observations.

In the matter of SOR/2017-196 — Regulations Amending the Off-Road Small Spark-Ignition Engine Emission Regulations and Making a Consequential Amendment to Another Regulation, it was agreed that counsel to the committee would write to the designated instruments officer at the Department of Environment and Climate Change to share some of the committee's observations.

In the matter of SOR/2018-47 — Canada's 2018 G7 Presidency Privileges and Immunities Order, it was agreed that the file be closed.

In the matter of SOR/2018-50 — Order Amending the Schedule to the First Nations Fiscal Management Act, it was agreed that the file be closed.

The committee considered SOR/2013-181 — Regulations Amending the Corrections and Conditional Release Regulations.

In the matter of SOR/2010-107 — Regulations Amending the Class II Nuclear Facilities and Prescribed Equipment Regulations, it was agreed that counsel to the committee would write to the designated instruments officer at the Department of Public Safety to share some of the committee's observations.

In the matter of SI/2019-8 — Order Amending the Banff National Park of Canada Siksika Nation Castle Mountain Land and Timber Claim Settlement Agreement Rent and Fee Remission Order; and SI/2016-32 — Banff National Park of Canada Siksika Nation Castle Mountain Land and Timber Claim Settlement Agreement Rent and Fee Remission Order, it was agreed that the files be closed.

In the matter of SOR/2017-165 — Certificate of Supplementary Protection Regulations, it was agreed that the file be closed.

In the matter of SOR/2019-16 — Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order, it was agreed that the file be closed.

In the matter of SOR/2019-57 — Regulations Amending the Designation of Regulatory Provisions for Purposes of Enforcement (Canada Wildlife Act) Regulations (Miscellaneous Program), it was agreed that the file be closed.

In the matter of SOR/2019-80 — Regulations Repealing the Atlantic Pilotage Authority Non-compulsory Area Regulations, it was agreed that the file be closed.
