The Standing Joint Committee for the Scrutiny of Regulations met at 8:32 a.m., this day, in room 256-S, Centre Block, the joint chairs, the Honourable Senator Bob Runciman and Ms Chris Charlton, presiding.
Representing the Senate: The Honourable Senators Batters, Moore, Nancy Ruth, Runciman, Smith, P.C. (Cobourg), Tannas and Unger (7).
Representing the House of Commons: Dan Albas, Stella Ambler, Paulina Ayala, Mauril Bélanger, Garry Breitkreuz, Patrick Brown, Chris Charlton, Rob Clarke, François Pilon, Anne Minh-Thu Quach and Maurice Vellacott (11).
Also present: Jean-François Lafleur, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, General Counsel, and Cynthia Kirkby, Counsel, Parliamentary Information and Research Service, Library of Parliament.
In attendance: The official reporters of the Senate.
The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
In the matter of SI/2009-102 — Order Fixing the Date of the Coming into Force of Certain Sections of the Act, the committee considered a draft report.
Senator Tannas moved that the report, as amended, be adopted.
The question being put on the motion, it was adopted.
In the matter of SOR/2010-28 — Order Exempting Bands from the Operation of Section 32 of the Indian Act, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/76-373 — Prince Edward Island Potato Marketing Levies Order, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Farm Products Council of Canada with respect to certain comments made by the committee.
In the matter of SOR/2013-92 — Order 2013-87-03-01 Amending the Domestic Substances List; SOR/2013-135 — Order 2013-87-04-01 Amending the Domestic Substances List; and SOR/2013-136 — Order 2013-66-04-01 Amending the Domestic Substances List, it was agreed that the files be closed.
In the matter of SOR/2005-35 — Canadian Transportation Agency General Rules, it was agreed that counsel to the committee correspond with the President of the Canadian Transportation Agency with respect to certain comments made by the committee.
In the matter of SOR/2012-135 — Regulations Amending the Sulphur in Diesel Fuel Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2003-323 — Presentation of Persons (2003) Regulations; SOR/2005-385 — Regulations Amending the Presentation of Persons (Customs) Regulations and the Presentation of Persons (2003) Regulations; and SOR/2006-154 — Regulations Amending the Presentation of Persons (2003) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canada Border Services Agency with respect to certain comments made by the committee.
In the matter of SOR/2009-264 — Volatile Organic Compound (VOC) Concentration Limits for Architectural Coatings Regulations, it was agreed, on division, that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2011-197 — Regulations Amending the Government Contracts Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Treasury Board of Canada with respect to certain comments made by the committee.
In the matter of SOR/98-443 — Environmental Assessment Review Panel Service Charges Order, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Environmental Assessment Agency with respect to certain comments made by the committee.
In the matter of SOR/2009-20 — Regulations Amending the Wild Animal and Plant Trade Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Foreign Affairs and International Trade Canada with respect to certain comments made by the committee.
In the matter of SOR/2009-197 — Volatile Organic Compound (VOC) Concentration Limits for Automotive Refinishing Products Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2008-197 — Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2011-1 — Rules Amending the Rules of Procedure for Boards of Review, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2011-169 — Regulations Amending the Pari-Mutuel Betting Supervision Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Agriculture and Food Inspection Legal Services with respect to certain comments made by the committee.
In the matter of SOR/2012-144 — Order 2012-87-07-01 Amending the Domestic Substances List, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2013-78 — Regulations Amending the Fish Inspection Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2013-183 — Regulations Amending the Traffic on the Land Side of Airports Regulations, it was agreed that the file be closed.
