The Standing Joint Committee for the Scrutiny of Regulations met at 8:33 a.m., this day, in room 160-S, Centre Block, the joint chairs, the Honourable Senator Denise Batters and Ms. Chris Charlton, presiding.
Representing the Senate: The Honourable Senators Batters, Moore and Runciman (3).

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

At 9:11 a.m., the committee resumed.
In the matter of SOR/2010-120 — Maritime Occupational Health and Safety Regulations; and SOR/2011-87 — Aviation Occupational Health and Safety Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Employment and Social Development Canada with respect to certain comments made by the committee.
In the matter of SOR/2012-23 — Negative Option Billing Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Finance Canada with respect to certain comments made by the committee.
In the matter of SOR/2001-390 — Form of Proxy (Banks and Bank Holding Companies) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Finance Canada with respect to certain comments made by the committee.
In the matter of SOR/2010-68 — Mortgage Insurance Business (Banks, Authorized Foreign Banks, Trust and Loan Companies, Retail Associations, Canadian Insurance Companies and Canadian Societies) Regulations and SOR/2010- 69 — Mortgage Insurance Disclosure (Banks, Authorized Foreign Banks, Trust and Loan Companies, Retail Associations, Canadian Insurance Companies and Canadian Societies) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Finance Canada with respect to certain comments made by the committee.
In the matter of SOR/2005-173 — Regulations Amending the Canadian Aviation Regulations (Parts I, IV, V and VII), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.
In the matter of SOR/2014-75 — Regulations Amending the PCB Regulations and Repealing the Federal Mobile PCB Treatment and Destruction Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2002-227 — Immigration and Refugee Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Citizenship and Immigration Canada with respect to certain comments made by the committee.
In the matter of SOR/2015-8 — Order Amending Schedule 3 to the Canadian Environmental Protection Act, 1999, it was agreed that the file be closed.
In the matter of SOR/2015-9 — Order Amending the Beef Cattle Research, Market Development and Promotion Levies Order, it it was agreed that the file be closed. It was further agreed that counsel to the committee correspond with the Designated Instruments Officer of the Privy Council Office with respect to certain comments made by the committee.
In the matter of SOR/88-58 — Air Transportation Regulations; and SOR/96-335Air Transportation Regulations, amendment, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2003-363 — Antarctic Environmental Protection Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/92-620 — Corrections and Conditional Release Regulations; and SOR/96-108 — Corrections and Conditional Release Regulations, amendment, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Public Safety Canada with respect to certain comments made by the committee.
In the matter of SOR/97-109 — PCB Waste Export Regulations, 1996, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2002-301 — Interprovincial Movement of Hazardous Waste Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2009-162 — Chromium Electroplating, Chromium Anodizing and Reverse Etching Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2009-197 — Volatile Organic Compound (VOC) Concentration Limits for Automotive Refinishing Products Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2009-264 — Volatile Organic Compound (VOC) Concentration Limits for Architectural Coatings Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2011-261 — Regulations Amending the Off-Road Compression-Ignition Engine Emission Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.
In the matter of SOR/2006-75 — Regulations Amending the Canada Business Corporations Regulations, 2001, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Industry Canada with respect to certain comments made by the committee.
In the matter of SOR/2010-261 — Cribs, Cradles and Bassinets Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2011-197 — Regulations Amending the Government Contracts Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2008-120 — Vessel Operation Restriction Regulations; SOR/2010-34 — Regulations Amending the Vessel Operation Restriction Regulations; and SOR/2010-226 — Regulations Amending the Vessel Operation Restriction Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.
In the matter of SOR/2009-152 — Regulations Amending the Canadian Aviation Regulations (Parts I and VII), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2014-273 — Regulations Amending Certain Department of Finance Regulations (Miscellaneous Program), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of Interim Order Respecting Prohibited Items, it was agreed that the file be closed.
In the matter of SOR/93-492 — Maximum Amounts for Destroyed Animals Regulations, 1992, it was agreed that the file be closed.
In the matter of SOR/95-189 — Nova Scotia Offshore Area Petroleum Diving Regulations; SOR/88-600Canada Oil and Gas Diving Regulations; and SOR/88-601Newfoundland Offshore Area Petroleum Diving Regulations, it was agreed that the files be closed.
In the matter of SOR/97-61 — Regulations prescribing a territory for the purposes of the definition "country'' in the Customs Tariff, it was agreed that the file be closed.
