The Standing Joint Committee for the Scrutiny of Regulations met at 8:30 a.m., this day, in room 256-S, Centre Block, the joint chairs, the Honourable Senator Bob Runciman and Ms. Chris Charlton, presiding.

Representing the Senate: The Honourable Senators Batters, Hervieux-Payette, P.C., Moore, Nancy Ruth, Runciman, Smith, P.C. (Cobourg), Tannas and Unger (8).

Representing the House of Commons: Dan Albas, Stella Ambler, Rob Anders, Mauril Bélanger, Patrick Brown, Chris Charlton, Rob Clarke, Anne Minh-Thu Quach and Maurice Vellacott (9).

Acting members present for the House of Commons: Sana Hassainia for Paulina Ayala and Denis Blanchette for François Pilon (2).

Also present: Jean-François Lafleur, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, General Counsel, and Evelyne Borkowski-Parent, Counsel, Parliamentary Information and Research Service, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2002-145 — Manner of Disposal of Detained, Seized or Forfeited Goods Regulations (Preclearance Act), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2002-148 — Regulations Designating Persons and Categories of Persons — Other Than Travellers Destined for the United States — Who May Enter a Preclearance Area, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2004-109 — Regulations Amending the Pulp and Paper Effluent Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2013-117 — Regulations Amending Certain Regulations Made Under the Motor Vehicle Safety Act, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SI/2013-102 — Proclamation Declaring the Representation Order to be in Force Effective on the First Dissolution of Parliament that Occurs after May 1, 2014, it was agreed that the file be closed.

In the matter of SOR/2002-352 — Regulations Amending the Canadian Aviation Regulations (Parts I, VI and VIII), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2011-262 — Regulations Amending the Immigration and Refugee Protection Regulations, it was agreed that counsel will prepare a draft response for the joint committee's consideration.

In the matter of Amendments to the Fee Schedule: Fees to be paid for marine navigation services provided by the Canadian Coast Guard, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Fisheries and Oceans Canada with respect to certain comments made by the committee.

In the matter of SOR/93-246 — Citizenship Regulations, 1993 (As Amended by SOR/94-442, SOR/95-122, SOR/97-281, SOR/2009-108 and SOR/2010-209, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Citizenship and Immigration Canada with respect to certain comments made by the committee.

In the matter of SOR/2009-315 — Canada Oil and Gas Drilling and Production Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Natural Resources Canada with respect to certain comments made by the committee.

In the matter of SOR/2009-316 — Newfoundland Offshore Petroleum Drilling and Production Regulations; and SOR/2009-317 — Nova Scotia Offshore Petroleum Drilling and Production Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Natural Resources Canada with respect to certain comments made by the committee.

In the matter of SOR/2006-191 — Regulations Amending the Nuclear Security Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2008-119 — Regulations Amending Certain Regulations Made under the Nuclear Safety and Control Act, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/97-109 — PCB Waste Export Regulations, 1996, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-1 — Proclamation Amending the Chicken Farmers of Canada Proclamation, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Farm Products Council of Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-284 — Regulations Amending the Canada Grain Regulations, it was agreed that the file be closed.

In the matter of SOR/2013-157 — Regulations Amending the Canadian Forces Members and Veterans Re-establishment and Compensation Regulations, it was agreed that the file be closed.

In the matter of SOR/2014-39 — Regulations Amending the Farm Improvement and Marketing Cooperatives Loans and Fees Regulations, 1998, it was agreed that the file be closed.
