The Standing Joint Committee for the Scrutiny of Regulations met at 8:30 a.m., this day, in room 256-S, Centre Block, the joint chairs, the Honourable Senator Denise Batters and Ms. Chris Charlton, presiding.

Representing the Senate: The Honourable Senators Batters, Fortin-Duplessis, Hervieux-Payette, P.C., McInnis, Moore, Runciman and Smith, P.C. (Cobourg) (7).

Representing the House of Commons: Dan Albas, Paulina Ayala, Mauril Bélanger, Chris Charlton, Jim Hillyer, François Pilon and Anne Minh-Thu Quach (7).

Acting member present for the House of Commons: Joe Preston for Garry Breitkreuz and Blaine Calkins for Patrick Brown (2).

Also present: David Chandonnet, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, General Counsel and Shawn Abel, Counsel, Parliamentary Information and Research Service, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/94-686 — Income Tax Regulations, amendment, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2013-64 — Regulations Amending the Employment Insurance Regulations, it was agreed that counsel to the committee draft a report in this matter to be reviewed by the committee on March 12, 2015.

In the matter of SOR/99-142 — Canada Lands Surveyors Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Natural Resources Canada with respect to certain comments made by the committee.

In the matter of SOR/2014-91 — Regulations Establishing Conditions for Making Regulations Under Subsection 36(5.2) of the Fisheries Act, it was agreed that counsel to the committee have a conversation with the Designated Instrument Officer of Environment Canada and report to the committee in early March 2015.

In the matter of SOR/2005-379 — Assessable Activities, Exceptions and Executive Committee Projects Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Indian and Northern Affairs Canada with respect to certain comments made by the committee.

In the matter of SOR/2011-284 — Regulations Amending the Canadian Aviation Regulations (Parts I and IV — Conduct of Flight Tests), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2012-23 — Negative Option Billing Regulations, it was agreed that the joint chairs correspond with the Deputy Minister of Finance Canada with a copy to the Assistant Deputy Minister regarding certain comments made by the committee.

In the matter of SOR/2002-76 — Marine Activities in the Saguenay-St. Lawrence Marine Park Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2010-4 — By-law Amending the Canada Deposit Insurance Corporation Differential Premiums By-law, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/93-382 — Prince Edward Island Cattle Marketing Levies Order, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Farm Products Council of Canada with respect to certain comments made by the committee.

In the matter of SOR/2007-76 — Regulations Amending the Food and Drug Regulations (1158 — Food Additives), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2009-20 — Regulations Amending the Wild Animal and Plant Trade Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2011-281 — Regulations Amending the Food and Drug Regulations (1618 — Food Additive), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2014-44 — Freezing Assets of Corrupt Foreign Officials (Ukraine) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Foreign Affairs, Trade and Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2010-111 — Regulations Amending the Phytophthora Ramorum Compensation Regulations, it was agreed that the file be closed.

In the matter of SOR/2014-225 — Regulations Amending the Industrial Design Regulations (Miscellaneous Program), it was agreed that the file be closed.

The committee considered the following Statutory Instruments without comment:

SI/2013-129 — Proclamation Giving Notice that the Agreement on Social Security between Canada and the Kingdom of Norway Comes into Force on January 1, 2014;

SI/2014-54 — Proclamation Giving Notice that the Second Protocol Amending the Convention between Canada and the Republic of Austria for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with respect to Taxes on Income and on Capital, done at Vienna on December 9, 1976, as amended by the Protocol done at Vienna on June 15, 1999 Came into Force on October 1, 2013;

SI/2014-55 — Proclamation Giving Notice that the Protocol Amending the Agreement between Canada and Barbados for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with respect to Taxes on Income and on Capital, done at Bridgetown on January 22, 1980 Came into Force on December 17, 2013;

SI/2014-67 — Proclamation Giving Notice that the Agreement on Social Security between Canada and the Federative Republic of Brazil Comes into Force on August 1, 2014;

SI/2014-77 — Yolande Laurence Remission Order;

SI/2014-79 — Order Fixing October 12, 2014 as the Day on which Certain Sections of the Act Come into Force;

SI/2014-80 — Proclamation Designating "Fire Prevention Week";

SI/2014-82 — Order Fixing the Day on which this Order is made as the Day on which Section 277 of the Economic Action Plan 2013 Act, No. 2 Comes into Force;

SOR/2014-15 — Regulations Amending the Canadian Aviation Regulations (Part IV);

SOR/2014-70 — Royal Canadian Mounted Police (Dependants) Pension Fund Increase in Benefits Order;
