The Standing Joint Committee for the Scrutiny of Regulations met at 8:42 a.m., this day, in room 256-S, Centre Block, the joint chairs, the Honourable Senator Bob Runciman and Ms. Françoise Boivin, presiding.

Representing the Senate: The Honourable Senators Braley, Frum, Harb, Hervieux-Payette, P.C., Moore, Runciman and Verner, P.C. (7).

Representing the House of Commons: Dan Albas, Françoise Boivin, Garry Breitkreuz, Patrick Brown, Rod Bruinooge, Pierre Dionne Labelle, Jean-François Larose, Massimo Pacetti, Andrew Saxton, Glenn Thibeault, Brad Trost and David Wilks (12).

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19 of the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of C.R.C. c. 954 — Indian Estates Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Aboriginal Affairs and Northern Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2010-158 — Beef Cattle Research, Market Development and Promotion Levies Order, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Farm Products Council of Canada with respect to certain comments made by the committee.

In the matter of SOR/2010-79 — Regulations Amending the Ocean Dumping Permit Fee Regulations (Site Monitoring) (Miscellaneous Program), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2001-532 — Telecommunications Apparatus Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Industry Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-196 — Natural Health Products Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2007-302 — Regulations Amending the Food and Drug Regulations and the Dairy Products Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/2008-273 — PCB Regulations, it was agreed that the file be closed.

In the matter of SOR/2009-314 — Regulations Amending the Fish Inspection Regulations, it was agreed that the file be closed.

In the matter of SOR/2002-354 — Regulations Amending Certain Regulations Administered and Enforced by the Canadian Food Inspection Agency, 2002-1 (Miscellaneous Program), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/2007-206 — Regulations Amending Certain Regulations Made under the Hazardous Products Act (Flame Resistance Test Method), it was agreed that the file be closed.

In the matter of SOR/2007-282 — Directive to the Canadian Nuclear Safety Commission Regarding the Health of Canadians, it was agreed that the file be closed.

In the matter of SI/2009-94 — Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (Saoyú-Æehdacho (Grizzly Bear Mountain and Scented Grass Hills) National Historic Site) Order, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Aboriginal Affairs and Northern Development Canada with respect to certain comments made by the committee.

In the matter of SI/2010-18 — Withdrawal from Disposal, Setting Apart and Appropriation of Certain Tracts of Territorial Lands in the Northwest Territories (Reindeer Grazing Reserve) Order, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Aboriginal Affairs and Northern Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-355 — Off-Road Small Spark-Ignition Engine Emission Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/94-753 — Indian Oil and Gas Regulations, 1995, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Aboriginal Affairs and Northern Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-206 — Regulations Amending the National Parks of Canada Fishing Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Parks Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-12 — Regulations Amending the Canadian Broiler Hatching Egg and Chick Licensing Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Farm Products Council of Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-268 — Regulations Amending the Industrial Design Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Intellectual Property Office with respect to certain comments made by the committee.

In the matter of SI/2010-83 — Withdrawal from Disposal of Certains Tracts of Territorial Lands in the Northwest Territories (Dechcho First Nations) Order, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2000-374 — Regulations Amending the Canada Occupational Safety and Health Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2006-147 — Regulations Amending Certain Regulations Administered and Enforced by the Canadian Food Inspection Agency, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2010-257 — Order Amending the Export and Import Permits and Certificates Fees Order, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2010-310 — Regulations Amending the Reportable Diseases Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2008-315 — Regulations Amending Certain Department of Industry Regulations, it was agreed that the file be closed.

In the matter of SOR/2010-89 — Regulations Amending the Public Service Employment Regulations, it was agreed that the file be closed.

In the matter of SOR/2011-48 — Regulations Amending the Reporting of Imported Goods Regulations (Miscellaneous Program), it was agreed that the file be closed.

In the matter of SOR/2011-71 — Regulations Amending the Secure Electronic Signature Regulations (Miscellaneous Program), it was agreed that the file be closed.
