Pursuant to the orders of the Senate of February 10, 2022 and February 1, 2023 and the order of the House of Commons of November 25, 2021, the Standing Joint Committee for the Scrutiny of Regulations met this day in room W120, 1 Wellington Street., and with videoconference, at 11:02 a.m., the joint chairs, the Honourable Yuen Pau Woo and Dan Albas, presiding. 

Representing the Senate: The Honourable Senators Dalphond and Woo (2).

Representing the House of Commons: Dan Albas, Dean Allison, Jenica Atwin, Élisabeth Brière, Jean-Denis Garon, Marty Morantz, Len Webber and Sameer Zuberi (8).

Representing the House of Commons by videoconference: Shaun Chen, Taleeb Noormohamed and Randall Garrison (3).

The committee proceeded to consider its permanent order of reference, as set out in section 19 of the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of U2010-6, Interim Order Respecting Identity Screening, it was agreed that the file be closed.

In the matter of SI/2019-93, Order Fixing the Days on which Certain Sections of that Act Come into Force, it was agreed that committee counsel write to the Designated Instruments Officer of the Privy Council Office with respect to certain comments made by the committee.

In the matter of SOR/2019-212, Regulations Amending the Immigration and Refugee Protection Regulations (Miscellaneous Program), it was agreed that committee counsel write to the Designated Instruments Officer of Immigration, Refugees and Citizenship Canada with respect to certain comments made by the committee.

In the matter of SOR/2016-14, Regulations Amending the Regulations Implementing the United Nations Resolutions on Iran, it was agreed that committee counsel write to the Designated Instruments Officer of Global Affairs Canada with respect to certain comments made by the committee.

In the matter of SOR/2020-106, Regulations Amending the Income Tax Regulations (COVID-19 — Deemed Remittance), it was agreed that the file by closed.

In the matter of SOR/2016-38, Regulations Amending the Protection of Passenger Information Regulations (before the committee on April 11, 2019), it was agreed that committee counsel write to the Designated Instruments Officer of the Canada Border Services Agency with respect to certain comments made by the committee.

In the matter of SOR/2016-37, Regulations Amending the Immigration and Refugee Protection Regulations (before the committee on April 11, 2019), it was agreed that committee counsel write to the Designated Instruments Officer of the Canada Border Services Agency with respect to certain comments made by the committee.

In the matter of SOR/1989-93, Ontario Fishery Regulations, 1989 (before the committee on October 22, 1998, February 17, 2000, March 23, 2000, April 5, 2001, June 7, 2001, February 21, 2002, April 3, 2003, March 11, 2004, November 4, 2004, March 10, 2005, May 5, 2005, June 1, 2006, September 28, 2006, November 23, 2006, December 7, 2006, February 1, 2007, December 13, 2007, March 5, 2009, May 28, 2009, February 16, 2012, October 4, 2012, May 9, 2013, May 1, 2014 and September 25, 2014), it was agreed that the file be closed.

In the matter of SOR/2007-90, Rules Amending the Patent Rules (before the committee on April 6, 2017 and November 8, 2018), it was agreed that the file be closed.

In the matter of SOR/2016-82, Critical Habitat of the Nooksack Dace (Rhinichthys cataractae ssp.) Order (before the committee on June 15, 2017, February 15, 2018 and November 8, 2018) and SOR/2020-171, Order Amending the Critical Habitat of the Nooksack Dace (Rhinichthys cataractae ssp.) Order, it was agreed that committee counsel write to the Designated Instruments Officer of Fisheries and Oceans Canada with respect to certain comments made by the committee and that the file be closed.

In the matter of SOR/2019-90, Regulations Amending the Concentration of Phosphorus in Certain Cleaning Products Regulations, it was agreed that the file be closed.
