Pursuant to the orders of the Senate of February 10, 2022 and February 1, 2023 and the order of the House of Commons of November 25, 2021, the Standing Joint Committee for the Scrutiny of Regulations met this day in room W120, 1 Wellington Street, and with videoconference, at 11:06 a.m., the joint chairs, the Honourable Yuen Pau Woo and Dan Albas, presiding. 

Representing the Senate: The Honourable Senators Dalphond, Dean and Woo (3).

Representing the House of Commons: Dan Albas, Dean Allison, Jenica Atwin, Élisabeth Brière, Scot Davidson, Jean-Denis Garon, Randall Garrison, Yasir Naqvi and Len Webber (9).

The committee proceeded to consider its permanent order of reference, as set out in section 19 of the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/94-276, Canadian Forces Superannuation Regulations, amendment (reviewed by the committee on June 11, 1998, April 5, 2001, May 31, 2007, March 3, 2011, March 1, 2012, November 21, 2013, December 8, 2016, May 16, 2022, February 13, 2023 and May 1, 2023), it was agreed that committee counsel write to the Designated Instruments Officer of the Department of National Defence with respect to certain comments made by the committee and that senior officials be invited to appear before the committee on June 5, 2023.

In the matter of SOR/2002-35, Canadian Chicken Marketing Levies Order (before the committee on May 31, 2013, October 9, 2014 and May 28, 2015), SOR/2006-180, Order Amending the Canadian Chicken Marketing Levies Order (before the committee on May 31, 2013, October 9, 2014 and May 28, 2015), SOR/2007-251, Order Amending the Canadian Chicken Marketing Levies Order (before the committee on May 31, 2013, October 9, 2014 and May 28, 2015), SOR/2015-228, Order Amending the Canadian Chicken Marketing Levies Order and SOR/2017-213, Order Amending the Canadian Chicken Marketing Levies Order, it was agreed that committee counsel write to the Designated Instruments Officer of the Farm Products Council of Canada and the Department of Justice Canada with respect to certain comments made by the committee.

In the matter of SI/2015-33, Order Amending the Canadian Passport Order (before the committee on May 19, 2016, November 3, 2016 and November 2, 2017) and SI/2019-27, Order Amending the Canadian Passport Order, it was agreed that committee counsel write to the Designated Instruments Officer of Public Safety Canada and Immigration, Refugees and Citizenship Canada with respect to certain comments made by the committee.

In the matter of SI/2019-62, Order Fixing the Day on which this Order is Made as the Day on which Division 19 of the Budget Implementation Act. 2019, No. 1 Comes into Force, it was agreed that the file be closed.

In the matter of SOR/2003-363, Antarctic Environmental Protection Regulations (before the committee on May 3, 2007, April 17, 2008, April 29, 2010, December 1, 2011, December 6, 2012, June 6, 2013, December 4, 2014, June 11, 2015, May 19, 2016 and November 1, 2018), it was agreed that committee counsel write to the Designated Instruments Officer from Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2016-38, Regulations Amending the Protection of Passenger Information Regulations (before the committee on April 11, 2019 and April 17, 2023), it was agreed that committee counsel write to the Designated Instruments Officer from the Canada Border Services Agency with respect to certain comments made by the committee.

In the matter of SOR/2011-294, Regulations Amending the Environmental Emergency Regulations (before the committee on February 28, 2013 and March 12, 2015), it was agreed that the file be closed.

In the matter of SOR/2010-261, Cribs, Cradles, and Bassinets Regulations (before the committee on March 1, 2012, February 14, 2013 and June 11, 2015), it was agreed that the file be closed.

In the matter of SOR/2017-195, Regulations Amending the Ontario Fishery Regulations, 2007, it was agreed that the file be closed.

In the matter of SOR/2016-174, Glass Doors and Enclosures Regulations (before the committee on June 13, 2019), it was agreed that the file be closed.

In the matter of SOR/2018-141, Regulations Amending the Use of Patented Products for International Humanitarian Purposes Regulations (Miscellaneous Program), it was agreed that the file be closed.

In the matter of SOR/2019-7, Regulations Amending the Canadian Egg Marketing Agency Quota Regulations, 1986, it was agreed that the file be closed.

In the matter of SOR/2016-230, Access to Cannabis for Medical Purposes Regulations, it was agreed that the file be closed.

The committee considered the following Statutory Instruments without comment, and agreed that these files be closed: SOR/2019-132, Regulations Amending the Pacific Fishery Regulations, 1993 (Lights Prohibited), SOR/2019-145, Order Amending Schedule 1 to the Species at Risk Act, SOR/2019-146, Order Calling in Certain Notes, SOR/2019-172, Regulations Amending the Licensed Dealers for Controlled Drugs and Narcotics (Veterinary Use) Fees Regulations and the Fees in Respect of Drugs and Medical Devices Regulations, SOR/2019-178, Issuance of two $1 circulation coins with a design commemorating the 75th anniversary of the United Nations Charter, SOR/2019-180, Issuance of two $2 circulation coins with a design commemorating the 100th anniversary of the birth of Bill Reid, SOR/2019-231, Regulations Amending the Regulations Establishing a List of Entities, SOR/2019-255, Order Amending Schedule 5 to the Canada National Parks Act (Sunshine Village Ski Area), SOR/2019-256, Regulations Amending the Bank of Canada Notes Regulations and SOR/2019-287, Order Amending Schedule 1 to the Species at Risk Act.

At 12:09 p.m., the committee adjourned to the call of the joint chairs.
