Pursuant to the orders of the Senate of February 10, 2022, February 1, 2023, and September 19, 2024, and the Standing Orders of the House of Commons, the Standing Joint Committee for the Scrutiny of Regulations met this day in room W120, 1 Wellington Street, and with videoconference, at 10:59 a.m. ET, the joint chairs, the Honourable Yuen Pau Woo and Dan Albas, presiding.
Representing the Senate: The Honourable Senators Dalphond and Woo (2).
Representing the House of Commons: Dan Albas, Chris Bittle, Collin Carrie, Shaun Chen, Scot Davidson, Gord Johns, Marie-France Lalonde, Tim Louis, Denis Trudel, Len Webber and Sameer Zuberi (11).
Participating in the meeting: Tanya Dupuis, General Counsel, Geoffrey Hilton and Julie Béchard, counsels, Library of Parliament.
The committee proceeded to consider its permanent order of reference, as set out in Section 19 of the Statutory Instruments Act, R.S.C., 1985, C. S-22, which provides the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
In the matter of SOR/2003-363, Antarctic Environmental Protection Regulations, it was agreed that a Notice of Disallowance be sent to the Minister of Environment and Climate Change, pursuant to subsection 19.1 (2) of the Statutory Instruments Act.
In the matter of SOR/2008-120, Vessel Operation Restriction Regulations as amended by SOR/2010-34 and SOR/2010-226, it was agreed that committee counsel write to the Designated Instruments Officer of the Department of Transport with respect to certain comments made by the committee.
In the matter of SOR/2014-95, Experimental Lakes Area Research Activities Regulations, it was agreed that committee counsel write to the Designated Instruments Officer of the Department of the Environment with respect to certain comments made by the committee.
In the matter of SOR/2020-105, Canada Emergency Student Benefit Regulations, it was agreed that this file be closed.
In the matter of SOR/2016-38, Regulations Amending the Protection of Passenger Information Regulations, it was agreed that this file, as well as SOR/2024-65, Regulations Amending the Protection of Passenger Information Regulations (Miscellaneous Program), be closed.
In the matter of SOR/2019-133, Regulations Amending the Pest Control Products Regulations (Labelling), it was agreed that committee counsel write to the Designated Instruments Officer of the Department of Health with respect to certain comments made by the committee.
In the matter of U2020-8, Interim Order Respecting the Prevention and Alleviation of Shortages of Drugs in Relation to COVID-19, it was agreed that this file, as well as U2020-9, Interim Order Respecting Drug Shortages (Safeguarding the Drug Supply), be closed.
In the matter of SOR/2007-76, Regulations Amending the Food and Drug Regulations (1158 — Food Additives), it was agreed that committee counsel write to the Designated Instruments Officer of the Department of Health with respect to certain comments made by the committee.
In the matter of SOR/2007-31, Vessel Certificates Regulations, it was agreed that the file be closed.
In the matter of SOR/2021-274, Order Repealing the Establishment Licence Fees Remission Order (Indication of an Activity in respect of a COVID-19 Drug), it was agreed that this file, as well as SOR/2020-213, Establishment Licence Fees Remission Order (Indication of an Activity in respect of a COVID-19 Drug), be closed.
The committee considered the following statutory instruments without comment: SI/2020-7, Order Awarding the Operational Service Medal With the HAITI Ribbon; SI/2020-8, Order Awarding the Operational Service Medal With the SUDAN Ribbon; SI/2020-9, Order Awarding the Operational Service Medal With the HUMANITAS Ribbon; SI/2020-70, Order Designating the Commission that is Named the Joint Public Inquiry into the Nova Scotia April 2020 Tragedy as a Department for the Purposes of that Act; SI/2022-43, Proclamation Requesting that the People of Canada Set Aside September 19, 2022, as the Day on Which They Honour the Memory of Her Late Majesty Queen Elizabeth the Second, Who Passed Away on September 8, 2022; SI/2023-15, Proclamation Fixing Victoria Day as the Day for the Celebration in Canada of the Birthday of the Sovereign; SI/2022-29, Alan Walker Remission Order; SI/2021-99, Cédric Gouillart Remission Order; SI/2022-28, Moise Lafond Remission Order; SOR/2020-62, Income Support Payment Amount Regulations.
