Pursuant to the orders of the Senate of February 10, 2022 and February 1, 2023 and the order of the House of Commons of November 25, 2021, the Standing Joint Committee for the Scrutiny of Regulations met this day in room W120, 1 Wellington Street, and with videoconference, at 11:07 a.m. ET, the joint chairs, the Honourable Yuen Pau Woo and Dan Albas, presiding.
Representing the Senate: The Honourable Senators Dalphond and Woo (2).
Representing the House of Commons: Dan Albas, Jenica Atwin, Élisabeth Brière, Earl Dreeshan, Jean-Denis Garon, Randall Garrison and Sameer Zuberi (7).
Representing the House of Commons by videoconference: Dean Allison, Shaun Chen, Taleeb Noormohamed and Len Webber (4).

John Moffet made a statement and answered questions.
The committee proceeded to consider its permanent order of reference, as set out in section 19 of the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
In the matter of SI/2019-10, Remission Order in Respect of Fees for Claims Filed under the Hazardous Materials Information Review Act for Exemption from the Requirement to Disclose Confidential Business Information, it was agreed that the file be closed.
In the matter of SI/2019-33, Order Designating Certain Members of the Queen’s Privy Council for Canada to be Minister for the Purposes of this Act and Certain Sections of that Act in Certain Circumstances: (1) the Minister of Public Safety and Emergency Preparedness; (2) the Minister of Transport; and (3) the Minister of Foreign Affairs (before the committee on June 13, 2022), it was agreed that the file be closed.
In the matter of SI/2021-76, Order Designating (1) the Department of Canadian Heritage; (2) the Department for Women and Gender Equality; and (3) the Office of Infrastructure Canada to Provide Support to the Minister of Housing and Diversity and Inclusion, it was agreed that the file be closed.
In the matter of SOR/2008-202, Regulations Amending the Immigration and Refugee Protection Regulations (before the committee on April 15, 2010, December 5, 2013, December 4, 2014 and May 8, 2015), it was agreed that the file be closed.
In the matter of SOR/2003-2, On-Road Vehicle and Engine Emission Regulations (before the committee on December 3, 2009, November 18, 2010, May 1, 2014, May 5, 2016 and February 13, 2023), SOR/2005-149, Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations (before the committee on May 17, 2007, April 17, 2008, November 5, 2009, November 4, 2010, December 1, 2011, May 31, 2013, June 6, 2013, May 14, 2015, May 5, 2016 and February 13, 2023), and SOR/2008-197, Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (before the committee on May 13, 2010, May 10, 2012, March 27, 2014, November 6, 2014 and February 13, 2023), it was agreed that the joint chairs correspond with the President of the Treasury Board, the Minister of Justice and Attorney General and the Minister of Environment and Climate Change with respect to certain comments made by the committee.
At 12 p.m., the committee suspended.
At 12:01 p.m., the committee resumed.
It was agreed that the recording and transcription of this in camera meeting be permitted, that committee members’ staff be allowed to remain in the room, and that one copy of the transcript be kept with general counsel for consultation purposes by committee members.
At 12:02 p.m., the committee suspended.
At 12:03 p.m., pursuant to rule 12-16(3), the committee resumed in camera to discuss a draft agenda (future business).
At 12:21 p.m., the committee adjourned to the call of the joint chairs.
