Pursuant to the order of the Senate of Thursday, September 22, 2022 and the order of the House of Commons of Thursday, June 23, 2022, the Special Joint Committee on the Declaration of Emergency met this day in room 025-B, West Block, and with videoconference, at 6:35 p.m. ET, the joint chair, Mr. Matthew Green presiding.

Representing the Senate: The Honourable Senators Boniface and Harder, P.C. (2).

Representing the Senate by videoconference: The Honourable Senators Campbell and Carignan, P.C. (2).

Representing the House of Commons: Rachel Bendayan, Rhéal Éloi Fortin, Matthew Green, Glen Motz and Yasir Naqvi (5).

Representing the House of Commons by videoconference: Dane Lloyd and Arif Virani (2).

Participating in the meeting:  Stephanie Feldman and Colin Sawatzky analysts, Library of Parliament.

Pursuant to the order of reference adopted by the Senate on Thursday, March 3, 2022 and the House of Commons on Wednesday, March 2, 2022, the committee continued its review of the exercise of powers and the performance of duties and functions pursuant to the declaration of emergency that was in effect from Monday, February 14, 2022, to Wednesday, February 23, 2022.

The Honourable Senator Harder, P.C. moved:

That for the purpose of discussing witnesses and the committee's work plan, the committee move in camera.

After debate, the question being put on the motion, it was adopted.

Mr. Fortin moved:

That each department, person, and/or agency that produced documents with redacted portions be required to provide the Committee with an unredacted version of those documents, or an explanation of the grounds for each redaction, within 10 days of the adoption of this motion.

After debate, Mr. Virani moved:

 That the motion be amended by deleting the words“with an unredacted version of those documents”.

After debate, the question was put on the motion in amendment.

Mr. Virani raised a point of order concerning the continuation of debate.

The chair ruled the point of order out of order and that the vote should continue.

Mr. Virani appealed the chair’s ruling.

The question being put on whether the chair’s ruling shall be sustained, it was adopted on the following vote:

The Honourable Senators Boniface, Campbell, Carignan, P.C and Harder P.C. and Mr. Lloyd, Mr. Fortin, Mr. Green and Mr. Motz - [8]

NAYS

Ms. Bendayan, Mr. Naqvi and Mr. Virani - [3]

ABSTENTIONS

NIL

The question being put on the motion in amendment, it was adopted on the following vote:

YEAS

The Honourable Senators Boniface, Campbell and Harder P.C. and Ms. Bendayan, Mr. Naqvi and Mr. Virani - [6]

NAYS

The Honourable Senator Carignan, P.C. and Mr. Lloyd, Mr. Fortin, Mr. Green and Mr. Motz - [5]

ABSTENTIONS

NIL

Mr. Naqvi moved:

That the  motion be amended by replacing the number “10” with the number “30”.

After debate, at 7:05 p.m., the committee suspended.

At 7:08 p.m., the committee resumed.

With leave of the committee, Mr. Naqvi withdrew his motion in amendment.

It was agreed that the motion be amended to read:

That each department, person and/or agency that produced documents with redacted portions be required to provide the committee with an explanation of the grounds for each redaction in writing within 15 days.

The question being put on the motion as amended, it was adopted.

Mr. Fortin moved:

That an analyst be assigned to the work of the Joint Committee to monitor the work of the Rouleau Commission and report back to the Joint Committee with a summary of each day’s work, including the names of the witnesses heard and a brief summary of the information provided by the witnesses and the documents produced.

After debate, it was agreed that debate on the motion be adjourned.

It was agreed that the committee proceed in camera, on division.

At 7:36 p.m., the committee suspended.

At 7:49 p.m., the committee resumed in camera.

At 8:24 p.m., the committee adjourned to the call of the chair.
