Pursuant to the orders of the Senate of February 10, 2022 and February 1, 2023 and the order of the House of Commons of November 25, 2021, the Standing Joint Committee for the Scrutiny of Regulations met this day in room W120, 1 Wellington Street, and with videoconference, at 11:05 a.m. ET, the joint chair, the Honourable Yuen Pau Woo, presiding.
Representing the Senate: The Honourable Senators Dalphond, Dean and Woo (3).
Representing the House of Commons: Dan Albas, Dean Allison, Élisabeth Brière, Scot Davidson, Jean-Denis Garon, Randall Garrison, Len Webber and Sameer Zuberi (8).
Representing the House of Commons by videoconference: Jenica Atwin, Shaun Chen and Gaheer Iqwinder (3).

The joint clerk for the House of Commons presided over the election of the joint chair, House of Commons.
Mr. Allison moved:
That Mr. Albas be joint chair of the committee for the House of Commons.
The question being put on the motion, it was adopted.
The committee proceeded to consider its permanent order of reference, as set out in section 19 of the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
In the matter of SOR/94-276, Canadian Forces Superannuation Regulations, amendment, (before the Committee on June 11, 1998, April 5, 2001, May 31, 2007, March 3, 2011, March 1, 2012, November 21, 2013, December 8, 2016 and May 16, 2022), it was agreed that the joint chairs correspond with the Minister of National Defence with respect to certain comments made by the committee and invite the Minister to appear.
In the matter of Interim Orders Nos. 1 to 11 Respecting Mail, Cargo and Baggage (U2010-7), it was agreed that the file be closed.
In the matter of Interim Order Nos. 1 to 5 Respecting Passenger Identification and Behaviour Observation (U2011-4), it was agreed that the file be closed.
In the matter of SOR/2020-54, Regulations Maintaining the Safety of Persons in Ports and the Seaway, it was agreed that the filed be closed.
In the matter of SOR/2003-2, On-Road Vehicle and Engine Emission Regulations, (before the committee on December 3, 2009, November 18, 2010, May 1, 2014 and May 5, 2016) and SOR/2005-149, Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations, it was agreed that committee counsel write to the Designated Instruments Officer of Environment and Climate Change Canada with respect to certain comments made by the committee and that senior officials be invited to appear before the committee.
In the matter of SOR/2008-197, Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations, (before the committee on May 13, 2010, May 10, 2012, March 27, 2014 and November 6, 2014), it was agreed that officials from Environment and Climate Change Canada be invited to appear before the committee.
In the matter of SI/2018-77, Order designating the Minister of Democratic Institutions, a member of the Queen’s Privy Council for Canada, as the responsible minister for the purposes of the Referendum Act, SI/2018-78, Order designating the Minister of Democratic Institutions, a member of the Queen’s Privy Council for Canada, as the responsible minister for the purposes of the Electoral Boundaries Readjustment Suspension Act, 1994, and SI/2018-91, Order Designating the President of the Queen's Privy Council for Canada as the Minister for the purposes of the Act, it was agreed that the files be closed.
In the matter of SI/2019-34, Order Fixing the Date on which the Preclearance Act, 2016 Comes into Force as the Day on which the Agreement on Land, Rail, Marine and Air Transport Preclearance between the Government of Canada and the Government of the United States of America Enters into Force, it was agreed that the file be closed.
In the matter of SOR/2020-55, Regulations Amending the Immigration and Refugee Protection Regulations, it was agreed that the file be closed.
In the matter of SOR/2006-50, Canadian Forces Members and Veterans Re-Establishment and Compensation Regulations, (before the committee on April 2, 2009, April 15, 2010, November 21, 2013, June 12, 2014, November 20, 2014, October 20, 2016 and May 10, 2018), it was agreed that the file be closed.
In the matter of SOR/2014-173, Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations, it was agreed that the file be closed.
In the matter of SOR/2018-79, Regulations Amending Certain Canadian Food Inspection Agency Regulations, it was agreed that the file be closed.
In the matter of SOR/2018-253, Regulations Amending the Textile Labelling and Advertising Regulations, it was agreed that the file be closed.
The committee considered the following Statutory Instruments without comment: SI/2018-89, Order Designating the President of the Queen’s Privy Council for Canada as the Minister for the purposes of the Act; SI/2018-90, Order Designating the President of the Queen’s Privy Council for Canada as the Minister for the purposes of section 23 of the Act; SI/2018-99, Order Authorizing Canadians to accept and wear the Non-Article 5 North Atlantic Treaty Organization Medal for Service in relation to Operation “Sea Guardian”; SI/2018-105, Order Designating the President of the Queen’s Privy Council for Canada, a member of the Queen’s Privy Council for Canada, as the Minister for the purposes of that Act; SI/2018-106, Order Transferring from the Department of Industry to the Privy Council Office the control and supervision of that portion of the federal public administration in the Department of Industry known as the Internal Trade Directorate; SI/2018-107, Order Transferring from the Minister of Indian Affairs and Northern Development, to the Minister of State to assist the Minister of Indian Affairs and Northern Development, the powers, duties and functions of the Minister of Indian Affairs and Northern Development under certain Acts; SI/2019-2, Order (1) terminating the assignment of the Honourable Jane Philpott; (2) assigning the Honourable Seamus Thomas Harris O’Regan to assist the Minister of Indian Affairs and Northern Development and (3) assigning the Honourable Bernadette Jordan to assist the Minister of Industry and the Minister of Infrastructure and Communities; SI/2019-22, Order (1) repealing Order in Council P.C. 2018-1200 of September 25, 2018; and (2) designating the Minister of Democratic Institutions to be the Minister referred to in the Act; SI/2019-23, Order (1) repealing Order in Council P.C. 2018-1201 of September 25, 2018; and (2) designating the Minister of Democratic Institutions as the Minister for the purposes of the Act; SI/2019-48, Order Fixing the Day After the Day on which this Order is Made as the Day on which Subdivisions A and B of Division 7 of Part 6 of that Act Come into Force; SI/2019-57, Order Designating the Minister of Employment and Social Development as the appropriate Minister with respect to the Canadian Accessibility Standards Development Organization for the purposes of that Act; SI/2019-59, Order Designating the Minister of Employment and Social Development, a member of the Queen’s Privy Council for Canada, to be the Minister for the purposes of that Act; SI/2019-60, Order Designating the Minister of Public Works and Government Services, a member of the Queen’s Privy Council for Canada, as the Minister for the purposes of that Act; SI/2019-61, Order Designating the Minister of Citizenship and Immigration, who is a federal minister, to be the Minister referred to in that Act; SI/2019-63, Order Designating the Minister of Employment and Social Development, a member of the Queen’s Privy Council for Canada, as the Minister for the purposes of that Act; SI/2019-65, Order Designating the Minister of Natural Resources, a member of the Queen’s Privy Council for Canada, as the Minister for the purposes of the two Acts; SI/2019-68, Order Designating the Prime Minister as the Minister responsible for that Act; SI/2019-69, Order Designating the Prime Minister as the Minister responsible for that Act; SI/2019-74, Order Terminating the Assignment of the Honourable Seamus Thomas Harris O’Regan and the Honourable Dominic LeBlanc; SI/2019-75, Transfer of Duties Order.
