Pursuant to the orders of the Senate of February 10, 2022 and February 1, 2023 and the Standing Orders of the House of Commons, the Standing Joint Committee for the Scrutiny of Regulations met this day in room W120, 1 Wellington Street, and with videoconference, at 11:09 a.m. ET, the joint chairs, the Honourable Yuen Pau Woo and Dan Albas, presiding.

Representing the Senate: The Honourable Senators Dalphond, Dean and Woo (3).

Representing the House of Commons: Dan Albas, Scot Davidson, Gord Johns, Matt Jeneroux, Tim Louis, Denis Trudel and Sameer Zuberi (7).

Representing the House of Commons by videoconference: Colin Carrie, George Chahal, Nathaniel Erskine-Smith, Mike Kelloway and Taleeb Noormohamed (5).

Participating in the meeting: Christine Holke, Joint Clerk of the Committee, House of Commons; Stephanie Feldman and Geoffrey Hilton, counsels, Library of Parliament.

The committee proceeded to consider its permanent order of reference, as set out in section 19 of the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2014-198, Firearms Records Regulations (Classification), it was agreed that a notice of disallowance be sent to the Minister of Public Safety, Democratic Institutions and Intergovernmental Affairs and that the joint chairs also write to the Minister with respect to certain comments made by the committee.

In the matter of SOR/2010-107, Regulations Amending the Class II Nuclear Facilities and Prescribed Equipment Regulations, it was agreed that a notice of disallowance be sent to the Minister of Energy and Natural Resources as well as the Canadian Nuclear Safety Commission. It was also agreed that committee counsel write to the Designated Instruments Officer of the Canadian Nuclear Safety Commission with respect to certain comments made by the committee.

In the matter of SOR/2003-363, Antarctic Environmental Protection Regulations, it was agreed that the joint chairs correspond with the Minister of Environment and Climate Change and Climate Change Canada with respect to certain comments made by the committee.

In the matter of SOR/94-276, Canadian Forces Superannuation Regulations, amendment, it was agreed that committee counsel monitor the file’s status and continue to follow-up with the Designated Instruments Officer of the Department of National Defence on a quarterly basis.

In the matter of SOR/2015-81, Regulations Amending the Wild Animal and Plant Trade Regulations, it was agreed that the file be closed.

In the matter of SOR/2014-149, Regulations Amending the Coastal Fisheries Protection Regulations, it was agreed that the file be closed.

In the matter of SOR/2019-212, Regulations Amending the Immigration and Refugee Protection Regulations (Miscellaneous Program), it was agreed that the file be closed.

In the matter of SOR/2015-143, Regulations Amending the On Board Trains Occupational Safety and Health Regulations, it was agreed that the file be closed.

In the matters of SOR/2005-134, Navigation Safety Regulations, SOR/2005-135, Regulations Amending the Charts and Nautical Publications Regulations, 1995, SOR/2011-203, Voyage Data Recorder Regulations and SOR/2019-100, Regulations Amending the Navigation Safety Regulations (Automatic Identification Systems), it was agreed that the files be closed.

In the matters of SOR/2022-148, Regulations Repealing Certain Regulations Made Under the Special Import Measures Act and SOR/2018-13, Regulations Amending the Members of Panels (NAFTA) Regulations, it was agreed that the files be closed.

The committee considered the following statutory instruments without comment: SOR/2018-16, By-law Amending the Canadian Payments Association By-law No. 3 — Payment Items and Automated Clearing Settlement System; SOR/2019-349, Regulations Amending the National Energy Board Pipeline Damage Prevention Regulations — Authorizations (Miscellaneous Program); SOR/2020-65, Regulations Amending Certain Regulations Made Under the Special Import Measures Act (Miscellaneous Program); SI/2020-64, Proclamation Designating “Fire Prevention Week”; SI/2021-63, Proclamation Designating “Fire Prevention Week”; SI/2022-45, Proclamation Designating “Fire Prevention Week”; SI/2021-41, Proclamation Announcing the Appointment of the Governor General; SI/2019-102, Proclamation Summoning the Parliament to Meet on December 5, 2019 (DISPATCH OF BUSINESS); SI/2020-58, Proclamation Proroguing Parliament to September 23, 2020; SI/2020-59, Proclamation Summoning Parliament to Meet on September 23, 2020 (DISPATCH OF BUSINESS); SI/2019-122, Order Designating the Minister of Industry (1) as the Minister for the purposes of the Natural Sciences and Engineering Research Council Act; and (2) as the appropriate Minister with respect to the Natural Sciences and Engineering Research Council for the purposes of the Financial Administration Act; SI/2021-8, Proclamation Declaring March 11, 2021 as a “National Day of Observance”; SI/2021-17, Proclamation Requesting to Observe January 29 of Every Year as a National Day of Remembrance of the Québec City Mosque Attack and Action Against Islamophobia; SI/2023-16, Proclamation Requesting That the People of Canada Observe the First Friday in June of Every year as a National Day Against Gun Violence; SI/2021-2, Proclamation Requesting to Observe January 8 of Every Year as a National Day of Remembrance for Victims of Air Disasters; SI/2019-103, Order Repealing Certain Orders in Council; SI/2022-36, Order Fixing September 1, 2022 as the Day on Which Certain Provisions of the Select Luxury Items Tax Act Come into Force.
