Pursuant to the orders of the Senate of February 10, 2022 and February 1, 2023 and the Standing Orders of the House of Commons, the Standing Joint Committee for the Scrutiny of Regulations met this day in room W120, 1 Wellington Street, and with videoconference, at 11:03 a.m. ET, the joint chairs, the Honourable Yuen Pau Woo and Dan Albas, presiding.
Representing the Senate: The Honourable Senators Dalphond, Dean and Woo (3).
Representing the House of Commons: Dan Albas, Scot Davidson, Mike Kelloway, Tim Louis, Denis Trudel, Len Webber and Sameer Zuberi (7).
Representing the House of Commons by videoconference: Dean Allison, Nathaniel Erskine-Smith, Gord Johns and Taleeb Noormohamed (4).
Participating in the meeting: Christine Holke, Joint Clerk of the Committee, House of Commons; Elda Donnelly, Administrative Assistant, Senate of Canada; Tanya Dupuis, General Counsel, Julie Béchard, Julie Levesque and Geoffrey Hilton, counsels, Library of Parliament.
The committee proceeded to consider its permanent order of reference, as set out in section 19 of the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

At 11:41 a.m., the committee suspended.
At 11:51 a.m., the committee resumed.
It was agreed that the committee allow the audio recording of the in camera portion of today’s meeting and that one copy be kept with the general counsel for consultation.
In the matter of SOR/2014-176, Status of the Artist Act Procedural Regulations and SOR/2014-242, Regulations Amending the Status of the Artist Act Procedural Regulations, it was agreed that committee counsel write to the Designated Instruments Officer of the Canada Industrial Relations Board with respect to certain comments made by the committee.
In the matter of SOR/2022-112, Regulations Amending the Canada Education Savings Regulations (Miscellaneous Program), it was agreed that this file, as well as SOR/2018-275, Regulations amending the Canada Education Savings Regulations, be closed.
In the matter of SOR/2023-60, Regulations Amending and Repealing Certain Department of the Environment Regulations (Miscellaneous Program), it was agreed that this file, as well as SOR/99-318, Canada Port Authority Environmental Assessment Regulations and SOR/2011-139, Establishing Timelines for Comprehensive Studies Regulations, be closed.
In the matter of SOR/94-753, Indian Oil and Gas Regulations, 1995, it was agreed that this file be closed.
The committee considered the following statutory instruments without comment: SI/2019-113, Order Assigning the Honourable Mary F.Y. Ng, Minister of State (Small Business), to assist the Minister of Industry; SI/2019-114, Order Designating the Minister of Public Works and Government Services to be the Minister referred to in that Act; SI/2019-118, Order Designating the President of the Queen’s Privy Council for Canada as the Minister for the purposes of that Act; SI/2019-119, Order Designating the President of the Queen’s Privy Council for Canada as the responsible minister for the purposes of the Electoral Boundaries Readjustment Suspension Act, 1994; SI/2019-120, Order Designating the President of the Queen’s Privy Council for Canada as the responsible minister for the purposes of the Referendum Act; SI/2019-121, Order Designating the Minister of Industry as (1) the Minister for the purposes of the Social Sciences and Humanities Research Council Act; and (2) the appropriate Minister with respect to the Social Sciences and Humanities Research Council for the purposes of the Financial Administration Act; SI/2019-124, Order Designating the Deputy Prime Minister and Minister of Intergovernmental Affairs as the Minister for the purposes of that Act; SI/2019-133, Order Designating the Minister of Families, Children and Social Development to be the Minister for the purposes of that Act; SI/2019-126, Order Designating the Minister of Employment and Social Development, a Minister of the Crown, to be “the Minister” for the purposes of that Act; and SI/2020-40, Order Fixing June 4, 2020 as the Day on Which Certain Provisions of that Act Come into Force.
At 11:52 a.m., the committee suspended.
At 11:53 a.m., pursuant to rule 12-16(3), the committee resumed in camera.
It was agreed that Mr. Trudel be elected second vice-chair of the committee.
At 12:19 p.m., the committee adjourned to the call of the joint chairs.
