The Standing Joint Committee for the Scrutiny of Regulations met at 8:30 a.m. this day, in room 705, Victoria Building, the joint chairs, the Honourable Senator Bob Runciman and Ms. Chris Charlton, presiding.

Representing the Senate: The Honourable Senators Batters, Hervieux-Payette, P.C., Moore, Nancy Ruth, Runciman, Tannas and Unger (7).

Representing the House of Commons: Dan Albas, Stella Ambler, Paulina Ayala, Mauril Bélanger, Patrick Brown, Chris Charlton, Rob Clarke, François Pilon and Anne Minh-Thu Quach (9).

Acting members present for the House of Commons: Rick Dykstra for Garry Breitkreuz (1).

Also present: Andrew Lauzon and Jean-Marie David, Joint Clerks of the Committee (House of Commons); Peter Bernhardt, General Counsel, and Shawn Abel, Counsel, Parliamentary Information and Research Service, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2003-296 — Regulations Amending the Wildlife Area Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2013-156 — Order Amending the Schedule to the Export and Import of Rough Diamonds Act, it was agreed that the file be closed.

In the matter of SOR/2010-69 — Mortgage Insurance Disclosure (Banks, Authorized Foreign Banks, Trust and Loan Companies, Retail Associations, Canadian Insurance Companies and Canadian Societies) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2013-7 — Unsolicited Telecommunications Fees Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Radio-television and Telecommunications Commission with respect to certain comments made by the committee.

In the matter of SOR/2013-77 — Regulations Amending the Egg Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/2004-110 — Regulations Amending the Coastal Fisheries Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Fisheries and Oceans Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-62 — Canada Production Insurance Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Agriculture and Agri-Food Canada with respect to certain comments made by the committee.

In the matter of SOR/2006-241 — Regulations Amending the Food and Drug Regulations (Data Protection), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Heath Canada with respect to certain comments made by the committee.

In the matter of SOR/2010-68 — Mortgage Insurance Business (Banks, Authorized Foreign Banks, Trust and Loan Companies, Retail Associations, Canadian Insurance Companies and Canadian Societies) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-343 — Canadian Artists and Producers Professional Regulations Tribunal Procedural Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canada Industrial Relations Board with respect to certain comments made by the committee.

In the matter of SOR/2008-12 — Regulations Amending the Canadian Broiler Hatching Egg and Chick Licensing Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Farm Products Council of Canada with respect to certain comments made by the committee.

In the matter of SOR/77-595 — Counting of Service by Former Members of the Senate or House of Commons Regulations, No. 2, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Royal Canadian Mounted Police with respect to certain comments made by the committee.

In the matter of SOR/95-100 — Newfoundland Offshore Certificate of Fitness Regulations; SOR/95-104 — Newfoundland Offshore Petroleum Installations Regulations; SOR/95-144 — Nova Scotia Offshore Area Petroleum Geophysical Operations Regulations; SOR/95-187 — Nova Scotia Offshore Certificate of Fitness Regulations; SOR/ 95-191 — Nova Scotia Offshore Petroleum Installations Regulations; SOR/95-334 — Newfoundland Offshore Area Petroleum Geophysical Operations Regulations; SOR/96-114 — Canada Oil and Gas Certificate of Fitness Regulations; SOR/96-117 — Canada Oil and Gas Geophysical Operations Regulations; and SOR/96-118 — Canada Oil and Gas Installations Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Natural Resources Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-206 — Regulations Amending the National Parks of Canada Fishing Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2011-261 — Regulations Amending the Off-Road Compression-Ignition Engine Emission Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-247 — New Substances Notification Regulations (Chemicals and Polymers), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2005-248 — New Substances Notification Regulations (Organisms), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2014-5 — Regulations Amending the Prescribed Information for the Description of a Designated Project Regulations; and SOR/2012-148 — Prescribed Information for the Description of a Designated Project Regulations, it was agreed that the files be closed.

SI/2013-108 — Order Fixing November 1, 2013 as the Day on which the Act Comes into Force;

SI/2013-109 — Transfer of Duties Order;

SI/2013-110 — Order Repealing Order in Council P.C. 2008-12 and Designating the Minister of Health as the appropriate Minister with respect to the Canadian Food Inspection Agency for the purposes of the Act;

SI/2013-111 — Order Fixing November 1, 2013 as the Day on which the Act Comes into Force;

SI/2013-112 — Order Fixing October 24, 2013 as the Day on which the Act Comes into Force;

SI/2013-114 — Order Repealing Order in Council P.C. 1999-472 and Designating the Minister of Industry for the purposes of the Act;

SI/2013-115 — Order Fixing November 1, 2013 as the Day on which the Act Comes into Force;

SI/2013-116 — Order Fixing November 25, 2013 as the Day on which Certain Provisions of the Act Come into Force;

SI/2013-118 — Order Amending the Access to Information Act Heads of Government Institutions Designation Order;
