The Standing Joint Committee for the Scrutiny of Regulations met at 8:33 a.m., this day, in room 256-S, Centre Block, the joint chairs, the Honourable Senator Bob Runciman and Ms. Chris Charlton, presiding.

Representing the Senate: The Honourable Senators Batters, Bellemare, Braley, Harb and Runciman (5).

Representing the House of Commons: Rob Anders, Paulina Ayala, Patrick Brown, Chris Charlton, Réjean Genest, Massimo Pacetti, Andrew Saxton, Mark Strahl, Maurice Vellacott and Wai Young (10).

Acting members present for the House of Commons: Jim Hillyer for Garry Breitkreuz and Libby Davies for Brian Masse (2).

Also present: Paul Cardegna, Joint Clerk of the Committee (House of Commons); Shawn Abel and Jacques Rousseau, Counsel, Parliamentary Information and Research Service, Library of Parliament.

In attendance: The official reporters of the Senate.

It was agreed:

That the following budget application in the amount of $10,000 be approved and that the House of Commons portion of this budget be paid for using the regular operations budget provided by the Liaison Committee of the House of Commons:

The question being put on the motion, it was adopted.

At 8:35 a.m., the committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/94-348 — Royal Canadian Mounted Police Pension Continuation Regulations, amendment; SOR/95-571 — Royal Canadian Mounted Police Superannuation Regulations, amendment; and SOR/98-531 — Regulations Amending the Royal Canadian Mounted Police Superannuation Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2010-28 — Order Exempting Bands from the Operation of Section 32 of the Indian Act, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/88-58 — Air Transportation Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Transportation Agency with respect to certain comments made by the committee.

In the matter of SOR/2000-183 — Regulations Amending and Repealing Certain Regulations Administered and Enforced by the Canadian Food Inspection Agency, 1999-2 (Miscellaneous Program), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/2009-258 — Regulations Amending the Cost of Borrowing (Banks) Regulations; SOR/2009- 259 — Regulations Amending the Cost of Borrowing (Authorized Foreign Banks) Regulations; SOR/2009-260 — Regulations Amending the Cost of Borrowing (Trust and Loan Companies) Regulations; SOR/2009-261 — Regulations Amending the Cost of Borrowing (Retail Associations) Regulations; SOR/2009-262 — Regulations Amending the Cost of Borrowing (Canadian Insurance Companies) Regulations; and SOR/2009-263 — Regulations Amending the Cost of Borrowing (Foreign Insurance Companies) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2001-316 — Order Amending the Schedule to the Customs Tariff (Harmonized System, 2002), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-219 — Regulations Amending the Canada Grain Regulations, it was agreed that the file be closed.

In the matter of SOR/2010-191 — Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations Respecting the Pest Control Products Act and Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-438 — Regulations Amending Certain Regulations Administered and Enforced by the Canadian Food Inspection Agency, 2002-2 (Miscellaneous Program), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2008-80 — Regulations Amending the Laurentian Pilotage Authority Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-181 — Regulations Amending the Food and Drug Regulations (1369 — Interim Marketing Authorizations), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2011-17 — Toys Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/92-446 — Transportation Safety Board Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Transportation Safety Board of Canada with respect to certain comments made by the committee.

In the matter of SOR/2000-273 — Tobacco Reporting Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-148 — Regulations Amending the Definition of ``Small Cable Transmission System'' Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Industry Canada with respect to certain comments made by the committee.

In the matter of SOR/2004-27 — Regulations Amending the Collision Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2011-294 — Regulations Amending the Environmental Emergency Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken

In the matter of SOR/2012-153 — Regulations Amending the Canada Grain Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Grain Commission with respect to certain comments made by the committee.

In the matter of SOR/2011-116 — Regulations Amending the Public Service Staffing Tribunal Regulations, it was agreed that the file be closed.

In the matter of SOR/2012-136 — Regulations Amending the Canadian Aviation Regulations (Parts I, VI and VII), it was agreed that the file be closed.
