The Standing Joint Committee for the Scrutiny of Regulations met at 8:30 a.m., this day, in Room 256-S, Centre Block, the joint chairs, the Honourable Senator Bob Runciman and Ms. Chris Charlton, presiding.

Representing the Senate: The Honourable Senators Bellemare, Harb, Hervieux-Payette, P.C., Housakos, Moore and Runciman (6).

Representing the House of Commons: Dan Albas, Rob Anders, Ray Boughen, Garry Breitkreuz, Patrick Brown, Chris Charlton, Réjean Genest, Brian Masse, Massimo Pacetti, Andew Saxton and Maurice Vellacott (11).

Acting members present for the House of Commons: Tarik Brahmi for Paulina Ayala (1).

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of Bill S-12 — An Act to amend the Statutory Instruments Act and to make consequential amendments to the Statutory Instruments Regulations, the Honourable Senator Hervieux-Payette, P.C. moved:

That a representative from the Department of Justice Canada be invited to appear at the next meeting of the Standing Joint Committee for the Scrutiny of Regulations, and that a briefing from the counsel for this committee follow immediately.

Mr. Andrew Saxton moved:

That the motion be amended by requiring a briefing from counsel to this committee prior to determining whether representation from the Department of Justice Canada will be invited to appear.

After debate, the question being put on the motion in amendment, it was adopted.

In the matter of Fee Schedule (Fees to be Paid for Marine Navigation Services Provided by the Canadian Coast Guard), Mr. Dan Albas moved:

In the matter of SOR/95-212 — Plant Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/96-252 — Seeds Regulations, amendment, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2006-141 — Order 2006-87-04-01 Amending the Domestic Substances List, it was agreed that the file be closed.

In the matter of SOR/2012-41 — Regulations Amending the Canada Student Financial Assistance Regulations, it was agreed that the file be closed.

In the matter of SI/2012-23 — Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (Thaidene Nene (East Arm of Great Slave Lake) National Park Reserve) Order, it was agreed that the file be closed.

In the matter of SI/2012-24 — Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (South Slave / North Slave Regions) Order, it was agreed that the file be closed.

In the matter of SOR/2009-18 — Regulations Amending Certain Regulations Administered and Enforced by the Canadian Food Inspection Agency, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/90-576 — Atlantic Pilotage Authority Regulations, amendment, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/99-122 — Farm Improvement and Marketing Cooperatives Loans and Fees Regulations, 1998, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Agriculture and Agri-Food Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-198 — Regulations Amending the Seeds Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/2005-168 — Regulations Amending the Orderly Payment of Debts Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2012-42 — Regulations Amending the Veterans Health Care Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2011-229 — Regulations Amending the Employment Insurance Regulations, it was agreed that the file be closed.

In the matter of SOR/2012-22 — Regulations Amending the Metal Mining Effluent Regulations, it was agreed that the file be closed.

In the matter of SOR/2012-88 — Regulations Amending the Lobbyists Registration Regulations, it was agreed that the file be closed.

In the matter of SOR/2012-99 — Regulations Amending Certain Regulations Made Under Sections 160, 191 and 209 of the Canadian Environmental Protection Act, 1999 and Repealing the List of Hazardous Waste Authorities (Miscellaneous Program), it was agreed that the file be closed.
