The Standing Joint Committee for the Scrutiny of Regulations met at 8:40 a.m. this day, in room 256-S, Centre Block, the Acting Chair, Mr. Derek Lee, presiding.

Representing the Senate: The Honourable Senators John G. Bryden, Sheila Finestone, P.C., Mobina Jaffer, and Wilfred P. Moore (4).

Representing the House of Commons: Pierre Brien, Derek Lee, Paul Macklin, and Lynn Myers (4).

In attendance: Jean Michel Roy, Joint Clerk of the Committee (House of Commons); Philippe Mela, Acting Joint Clerk of the Committee, (House of Commons); François-R. Bernier and Margaret Jodoin-Rasmussen, Counsel to the Committee, Parliamentary Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

The committee considered its permanent Order of Reference, section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which follows:

19. Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
It was agreed that Mr. Lee be Acting Chair for this meeting.

On SOR/93-108 - Quebec Beef Cattle Producers' Levies or Charges (Interprovincial and Export Trade); SOR/93-195 - Quebec Maple Syrup Producers Levy (Interprovincial and Export trade Order); and SOR/93-382 - Prince Edward Island Cattle Marketing Levies Order, it was agreed that officials previously invited to appear on these instruments be again invited.

On SOR/91-373 - Conference of European Ministers of Justice Privileges and Immunities Order, 1991, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On the Committee's Fourth Report from the Fourth Session of the Thirtieth Parliament, dealing with SOR/77-1058, Import Control List amendment, and SOR/77-1059 - General Import Permit No. 57, it was agreed that the file be closed.

On C.R.C.c. 1238 - Northwest Territories Reindeer Regulations, it was agreed that a report recommending disallowance of certain portions of the Regulations be drafted and that the Joint Chairs correspond with the Minister of Indian Affairs and Northern Development with respect to certain comments made by the committee.

On SOR/95-155 - Small Business Loans Regulations, 1993, amendment, it was agreed that the file be closed.

The committee considered SOR/95-532 - Miscellaneous Amendments Regulations (Department of Industry) 1995-1.

On SOR/86-1078 - Import of Arms Permit, and SI/98-90 - Corrected Certificates Remission Order, it was agreed that the file be closed.

On SOR/97-457 - Copyright Regulations, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Industry with respect to certain comments made by the committee.

On SOR/88-560 - Cribs and Cradles Regulations, amendment, it was agreed that the Joint Chairs correspond with the Minister of Health with respect to certain comments made by the committee.

On SOR/94-419 - Canada Business Corporations Regulations, amendment, it was agreed that the file be closed.

On SOR/93-420 - Broadcasting Information Regulations, 1993; SOR/92-611 - Television Broadcasting Regulations, 1987, amendment; and SOR/92-609 - Radio Regulations, 1986 amendment, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/93-3 - Oil Pollution Prevention Regulations, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/91-419 - Hazardous Materials Information Review Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Hazardous Material Information Review Commission with respect to certain comments made by the committee.

On SOR/98-154 - Regulations Amending the Maple Products Regulations, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

On SOR/95-25 - Investment Canada Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Industry with respect to certain comments made by the committee.

On SOR/99-99 - Order Amending the Export Control List, and SOR/98-248 - Order Amending the Export Control List, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

The committee considered SOR/99-16 - Regulations Amending the Canada Business Corporations Regulations.

On SOR/2001-83 - Regulations Amending the Navigating Appliances and Equipment Regulations, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/98-240 - Rules Amending the Bankruptcy and Insolvency Rules, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Industry with respect to certain comments made by the committee.

The committee considered SOR/96-470 - Employment Equity Regulations.

On SOR/97-501 - Privileges and Immunities of the Secretariat of the Convention on Biological Diversity Order, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/95-32 - Import Control List, amendment, it was agreed that the file be closed.

The committee considered the following Statutory Instruments without comment:

SOR/99-357 - Regulations Amending the Motor Vehicle Safety Regulations (Brake Systems);

SOR/2000-341 - Regulations Amending the Board of Steamship Inspection Scale of Fees (Miscellaneous Program);
