The Standing Joint Committee for the Scrutiny of Regulations met at 8:35 a.m. this day, in room 172-E, Centre Block.

Representing the Senate: The Honourable Senators Sheila Finestone, P.C., Céline Hervieux-Payette, P.C., Wilfred P. Moore, Pierre Claude Nolin, and Terry Stratton (5).

Other senator present: The Honourable Senator Marcel Prud'homme, P.C. (1).

Representing the House of Commons: Pierre Brien (for Robert Lanctôt), Marlene Catterall (for Joe Commuzzi), John Cummins, Gurmant Grewal, Richard Harris (for Jim Gouk), Gar Knutson, Derek Lee, Paul Macklin, Lynn Myers, Jim Pankiw, Tom Wappel, and Lynne Yelich (for Ted White) (12).

In attendance: Jean-Michel Roy, Joint Clerk of the Committee (House of Commons), François-R. Bernier, and Peter Bernhardt, Counsel to the Committee, Research Branch, Library ofParliament.

Also in attendance: The official reporters of the Senate.

The Joint Clerk representing the House of Commons presided over the election of the House of Commons Joint Chair.

The Honourable Senator Nolin moved that Mr. Pankiw be elected House of Commons Joint Chair.

Mr. Harris moved that Mr. Grewal be elected House of Commons Joint Chair.

The question being put on the motion of the Honourable Senator Nolin, it was negatived by a show of hands: yeas 5; nays 7.

The question being put on the motion of Mr. Harris, it was adopted by a show of hands: yeas 8; nays 4.

The Joint Clerk representing the House of Commons declared Mr. Grewal duly elected House of Commons Joint Chair of the Committee.

The Joint Chairs took the Chair.

The committee proceeded to the election of a Vice-Chair.

The Honourable Senator Stratton moved that Mr. Pankiw be elected Vice-Chair of the Committee.

Mr. Lee moved that Mr. Wappel be elected Vice-Chair of the Committee.

The question being put on the motion of Mr. Pankiw, it was negatived by a show of hands: yeas 3; nays 13.

The question being put on the motion of Mr. Wappel, it was adopted by a show of hands: yeas 12; nays 3.

The committee considered its permanent Order of Reference, section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which follows:

19. Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutoryinstruments.

On SI/99-27 - Order Fixing May 29, 1999 as the Date of the Coming into Force of Certain Sections of the Act, it was agreed that the file be closed.

On SOR/93-43 - Order Varying a "letter decision" (Chandler Subdivision) Issued by the National Transportation Agency, it was agreed that the file be closed.

On SOR/98-258 - Regulations Amending the Canada Pension Plan Regulations, it was agreed that Counsel to the Committee review their status at a later date and inform the Committee of the action taken.

The committee considered SOR/95-586 - Atlantic Pilotage Tariff Regulations, 1996.

On SI/2000-105 - Order Fixing October 27, 2000 as the Date of the Coming into Force of Certain Sections of the Act, it was agreed that the file be closed.

The committee considered SOR/2000-348 - Order Amending the Canada Turkey Marketing Levies Order.

On SOR/93-332 - Aboriginal Communal Fishing Licences Regulations; SOR/94-390 - Aboriginal Communal Fishing Licences Regulations, amendment; SOR/94-531 - Aboriginal Communal Fishing Licences Regulations, amendment;and SOR/95-106 - Aboriginal Communal Fishing Licences Regulations, amendment, it was agreed that the Joint Chairs correspond with the Minister of Fisheries and Oceans with respect to certain comments made by the Committee.

On SI/97-96 - Non-Canadian Ships Safety Order, it was agreed that Counsel to the Committee review its status at a later date and inform the Committee of the action taken.

On SOR/91-370 - Honey Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by theCommittee.

On SOR/94-34 - Aviation Occupational Safety and Health Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Department of Human Resources Development with respect to certain comments made by the Committee.

On SOR/94-240 - Canada Ports Corporation Administrative By-law, revocation; SOR/94-319 - Prince Rupert PortCorporation Administrative By-law, revocation; SOR/94-332 - Halifax Port Corporation Administrative By-law, revocation; SOR/94-360 - St. John's Port Corporation Administrative By-law, revocation; SOR/95-318 - Port of Quebec Corporation Administrative By-law, repeal; and SOR/95-460 - Vancouver Port Corporation Administrative By-law, repeal, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Transport with respect to certain comments made by the Committee.

On SOR/95-548 - Miscellaneous Amendments Regulations (Department of Agriculture and Agri-Food) 1995-2, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the Committee.

On SOR/2000-411 - Regulations Amending the Canada Pension Plan Regulations, it was agreed that Counsel to the Committee correspond with the Designed Instruments Officer of the Department of Human Resources Development with respect to certain comments made by the Committee.

On SOR/98-128 - Receipt and Deposit of Public Money Regulations, 1997, it was agreed that the file be closed.

On SOR/2000-201 - Regulations Amending the Canadian Turkey Marketing Quota Regulations, 1990, it was agreed that the file be closed.

On SOR/2000-274 - Regulations Amending the Air Services Charges Regulations, it was agreed that the file be closed.
