The Standing Joint Committee for the Scrutiny of Regulations met at 8:40 a.m. this day, in Room 160-S, Centre Block, the Joint Chairs, the Honourable Céline Hervieux-Payette, P.C., and Mr. Gurmant Grewal, M.P., presiding

Representing the Senate: The Honourable Senators John Bryden, Céline Hervieux-Payette, P.C., Wilfred P. Moore, Pierre Claude Nolin, James Tunney, and Jack Wiebe (6).

Other Senators in attendance: The Honourable William Rompkey, P.C. (1).

Representing the House of Commons: Pierre Brien, John Cummins, Stan Dromisky (for Paul Bonwick), Gurmant Grewal, Paul Macklin, Lynn Myers, Jim Pankiw, Tony Tirabassi (for Joe Comuzzi), and Tom Wappel (9).

In attendance: Till Heyde, Joint Clerk of the Committee (Senate); Jean Michel Roy, Joint Clerk of the Committee (House of Commons); and François-R. Bernier, Jacques Rousseau, and Peter Bernhardt, Counsel to the Committee, Parliamentary Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

The committee considered its permanent Order of Reference, section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which follows:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

Mr. Cummins moved that committee staff must be seen to be neutral in matters of debate within committee and, therefore, should avoid public comment on such matters.

After debate, it was agreed that the motion of Mr. Cummins be referred to the Subcommittee on Agenda and Procedure for examination.

Mr. Pankiw moved that when the Minister of Fisheries and Oceans is scheduled to appear before the Committee for the purposes of addressing the Committee's concerns regarding the Aboriginal Communal Fishing Licences Regulations (SOR/93-332, SOR/94-390, SOR/94-531, SOR/95-106), the proceedings of the committee be televised.

After debate, the question being put on the motion, it was adopted.

The Joint Chair, Mr. Grewal, read into the record a letter from the Honourable Robert Thibault, P.C., M.P., dated February 20, 2002.

The committee discussed its business.

On C.R.C. c. 1325 — Public Lands Mineral Regulations, it was agreed that the Joint Chairs correspond with the Minister of Justice and Attorney General of Canada with respect to certain comments made by the committee and invite him either to appear or to provide a written response.

On SOR/89-93 — Ontario Fishery Regulations, 1989, it was agreed that the Joint Chairs correspond with the Minister of Fisheries and Oceans with respect to certain comments made by the committee and that staff prepare a draft report to both Houses.

On SOR/89-127 — Food and Drug Regulations amendment, it was agreed that the Joint Chairs correspond with the Minister of Agriculture and Agri-Food with respect to certain comments made by the committee.

On SOR/90-218 — Fresh Fruit and Vegetable Regulations amendment, Report No. 67, it was agreed that the Joint Chairs correspond with the President of the Queen's Privy Council for Canada with respect to certain comments made by the committee.

On SOR/92-721 — Fertilizers Regulations amendment, it was agreed that staff review their status at a later date and inform the committee of the action taken.

On SOR/97-302 — Regulations Amending the Maple Products Regulations, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

On SOR/97-521 — Regulations Amending the Hazardous Products (Ice Hockey Helmets) Regulations, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Health with respect to certain comments made by the committee.

It was agreed that consideration of other items on the agenda be deferred.

At 10:40 a.m., it was agreed that the committee adjourn to the call of the Joint Chairs.
