SUMMARY
This enactment amends the Employment Insurance Act to extend the qualifying period of an insured person by the number of weeks that the person was not employed in insurable employment because the person was residing with their spouse or common law partner who was employed outside of Canada in or with the Canadian Forces or the federal public administration. An extension under this new provision may result in a qualifying period of up to 260 weeks.
SOMMAIRE
Le texte modifie la Loi sur l’assurance-emploi afin de prolonger la période de référence d’un assuré du nombre de semaines pendant lesquelles la personne n’a pas exercé un emploi assurable parce qu’elle résidait avec son époux ou conjoint de fait, qui exerçait, au sein des Forces canadiennes ou de l’administration publique fédérale, un emploi à l’étranger. La prolongation accordée en vertu de cette nouvelle disposition porte la durée maximale d’une période de référence à deux cent soixante semaines.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. (1) Subsection 8(2) of the Employment Insurance Act is amended by adding the following after paragraph (b):
1. (1) Le paragraphe 8(2) de la Loi sur l’assurance-emploi est modifié par adjonction, après l’alinéa b), de ce qui suit :
(b.1) residing outside of Canada with the person’s spouse or common-law partner who at the time was employed outside of Canada in or with the Canadian Forces or the federal public administration;
b.1) elle résidait à l’étranger avec son époux ou conjoint de fait qui exerçait alors un emploi à l’étranger au sein des Forces canadiennes ou de l’administration publique fédérale;
(2) Subsection 8(7) of the Act is replaced by the following:
(2) Le paragraphe 8(7) de la même loi est remplacé par ce qui suit :
Maximum extension of qualifying period
(7) No extension under any of subsections (2) to (4) may result in a qualifying period of more than 104 weeks, except that an extension under paragraph (2)(b.1) may result in a qualifying period of up to 260 weeks.
(7) Il n’est accordé, en application des paragraphes (2) à (4), aucune prolongation qui aurait pour effet de porter la durée d’une période de référence à plus de cent quatre semaines, sauf s’il s’agit d’une prolongation au titre de l’alinéa (2)b.1), qui porte la durée maximale de la période de référence à deux cent soixante semaines.
