The Standing Joint Committee for the Scrutiny of Regulations met at 8:35 a.m., this day, in room 256-S, Centre Block, the joint chairs, the Honourable Senator J. Trevor Eyton and Mr. Derek Lee, presiding.

Representing the Senate: The Honourable Senators Bacon, Eyton, Harb and Moore (4).

Representing the House of Commons: Sue Barnes, David Christopherson, Ken Epp, Carole Freeman, Monique Guay, Rahim Jaffer, Denis Lebel, Derek Lee, Rick Norlock, and Tom Wappel (10).

Other member present: Brad Trost (1).

Also present: Christine Lafrance, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, General Counsel, and Shawn Abel, Counsel, Parliamentary Information and Research Services, Library of Parliament.

In Attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2002-145 — Manner of Disposal of Detained, Seized or Forfeited Goods Regulations (Preclearance Act), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Foreign Affairs with respect to certain comments made by the committee.

In the matter of SOR/89-93 — Ontario Fishery Regulations, 1989, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Fisheries and Oceans with respect to certain comments made by the committee.

In the matter of SOR/96-254 — Processing and Distribution of Semen for Assisted Conception Regulations; SOR/ 2000-299 — Regulations Amending the Processing and Distribution of Semen for Assisted Conception Regulations (1218 — Alternative Tests); SOR/2000-410 — Regulations Amending the Processing and Distribution of Semen for Assisted Conception Regulations (1238 — Special Access), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2004-263 — Regulations Amending Certain Regulations Made under the Fisheries Act (Miscellaneous Program), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Fisheries and Oceans with respect to certain comments made by the committee.

In the matter of SOR/2002-309 — Order Amending the British Columbia Vegetable Order, it was agreed that the joint chairs invite the officials of the National Farm Products Council to appear before the committee.

In the matter of SOR/97-109 — PCB Waste Export Regulations, 1996, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/94-753 — Indian Oil and Gas Regulations, 1995, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Indian and Northern Affairs with respect to certain comments made by the committee.

In the matter of SOR/2002-416 — Regulations Respecting Applications for Ministerial Review — Miscarriages of Justice, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Justice with respect to certain comments made by the committee.

In the matter of SOR/2005-373 — Political Activities Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Public Service Commission of Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-383 — Regulations Amending the Accounting for Imported Goods and Payment of Duties Regulations; SOR/2006-152 — Regulations Amending the Accounting for Imported Goods and Payment of Duties Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canada Border Services Agency with respect to certain comments made by the committee.

In the matter of SI/2002-17 — Order Fixing the Dates of the Coming into Force of Certain Sections of the Act, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2003-12 — Regulations Amending the Retirement Compensation Arrangements Regulations, No. 1, it was agreed that the file be closed.

In the matter of SOR/2002-73 — Regulations Amending the Retirement Compensation Arrangements Regulations, No.1; SOR/2003-317 — Regulations Amending the Canada Business Corporations Regulations, 2001, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/78-450 — Air Regulations, amendment; SOR/84-305 — Air Regulations, amendment; SOR/ 2007-152 — Order Amending the FIFA Men's U-20 World Cup Canada 2007 Remission Order; SOR/2007-181 — Regulations Amending Certain Canada Border Services Agency Regulations (Miscellaneous Program); SOR/2007-182 — Regulations Amending the Marine Occupational Safety and Health Regulations (Miscellaneous Program), it was agreed that the files be closed.

The committee considered the following statutory instruments without comment:
