The Standing Joint Committee for the Scrutiny of Regulations met at 8:30 a.m., this day, in room 256-S, Centre Block, the joint chair, Mr. Derek Lee, presiding.
Representing the Senate: The Honourable Senators Bacon, Bryden, Harb and Moore (4).
Representing the House of Commons: Gérard Asselin, Sue Barnes, Ken Epp, Carole Freeman, Luc Harvey, Derek Lee, Rick Norlock, Paul Szabo and Tom Wappel (9).
Also present: Christine Lafrance, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, General Counsel, and Lindsay Armstrong, Counsel, Parliamentary Information and Research Services, Library of Parliament.
In attendance: The official reporters of the Senate.
The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
In the matter of Report No. 80 — Incorporation by Reference (Government Response), it was agreed that the matter would be referred to the Subcommittee on Agenda and Procedure.
In the matter of SOR/2000-221 — Regulations Amending the Letter Mail Regulations, it was agreed that counsel to the committee prepare the file for discussion of potential disallowance and return it to the agenda for the next meeting on June 12, 2008.
In the matter of SOR/2003-109 — Regulations Amending the Employment Insurance Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Human Resources and Social Development Canada with respect to certain comments made by the committee.
In the matter of SOR/2004-121 — Regulations Amending the Canada Student Loans Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Human Resources and Social Development Canada with respect to certain comments made by the committee.
In the matter of SOR/2007-13 — Regulations Amending the Canada Pension Plan Board Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the department of Finance Canada with respect to certain comments made by the committee.
In the matter of SOR/2007-82 — Identity Screening Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.
In the matter of SOR/95-548 — Miscellaneous Amendments Regulations (Department of Agriculture and Agri-Food) 1995-2, it was agreed that the joint chairs correspond with the Minister of Agriculture and Agri-Food and Minister for the Canadian Wheat Board with respect to certain comments made by the committee.
In the matter of SOR/95-212 — Plant Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.
In the matter of SOR/97-85 — Regulations Amending the Health of Animals Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.
In the matter of SOR/2000-111 — Canadian Aviation Security Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.
In the matter of SOR/2002-188 — Regulations Amending the Canadian Aviation Security Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.
In the matter of SOR/2004-16 — Regulations Amending the Canadian Aviation Security Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.
In the matter of SOR/2006-340 — Regulations Amending the Canadian Aviation Security Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.
In the matter of SOR/2005-346 — Protection of Passenger Information Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Public Safety Canada with respect to certain comments made by the committee.
In the matter of SI/2002-17 — Order Fixing the Dates of the Coming into Force of Certain Sections of the Act, it was agreed that the file be closed.
In the matter of SI/2006-121 — Proclamation Giving Notice that the Agreement on Social Security Between Canada and the Republic of Estonia Comes Into Force on November 1, 2006, it was agreed that the file be closed.
In the matter of SI/2006-122 — Proclamation Giving Notice that the Agreement on Social Security Between Canada and the Republic of Latvia Comes Into Force on November 1, 2006, it was agreed that the file be closed.
In the matter of SI/2006-123 — Proclamation Giving Notice that the Agreement on Social Security Between Canada and the Republic of Lithuania Comes Into Force on November 1, 2006, it was agreed that the file be closed.
In the matter of SOR/95-571 — Royal Canadian Mounted Police Superannuation Regulations, amendment, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/98-531 — Regulations Amending the Royal Canadian Mounted Police Superannuation Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of S.C. 2002, c. 20 — Legislative Instruments Re-enactment Act, it was agreed that the file be closed.
In the matter of C.R.C. c. 1325 — Public Land Mineral Regulations, it was agreed that the file be closed.
In the matter of SOR/2000-294 — Canadian Forces Grievance Board Rules of Procedure (Review of a Grievance by Way of a Hearing), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2007-280 — Regulations Amending the Canadian Aviation Regulations (Part VI) (Miscellaneous Program), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2007-291 — Regulations Amending the Atlantic Pilotage Tariff Regulations, 1996, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
In the matter of SOR/2007-226 — Regulations Amending the Frontier Lands Registration Regulations, it was agreed that the file be closed.
