Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
|
|
|
|

1. The Criminal Code is amended by adding the following after section 264:
|
|
|
|
1. Le Code criminel est modifié par adjonction, après l’article 264, de ce qui suit :

|
|
Interference with hunting, trapping, fishing or sport shooting
|
|
264.01 (1) Everyone commits an offence who intentionally interferes with lawful hunting, trapping, fishing or sport shooting by
|
|
|
|
(a) tampering with or moving bait or a trap, net or firearm or any other thing or animal used for hunting, trapping, fishing or sport shooting;
|
|
|
|
(b) placing themselves in a position that hinders or prevents hunting, trapping, fishing or sport shooting; or
|
|
|
|
(c) engaging in an activity that disturbs or is likely to disturb wildlife, including fish.
|
|
|
|
264.01 (1) Commet une infraction quiconque entrave intentionnellement toute activité légale de chasse, de piégeage, de pêche ou de tir sportif de l’une ou l’autre des manières suivantes :
|
|
Entrave à la chasse, au piégeage, à la pêche ou au tir sportif
|
|
a) en manipulant ou en déplaçant un appât, un piège, un filet ou une arme à feu ou tout autre objet ou animal utilisé pour la chasse, le piégeage, la pêche ou le tir sportif;
|
|
|
|
b) en se plaçant de façon à gêner ou à empêcher le déroulement d’une activité de chasse, de piégeage, de pêche ou de tir sportif;
|
|
|
|
c) en pratiquant une activité qui dérange ou est susceptible de déranger la faune, notamment le poisson.
|
|
|
|
|
Exceptions
|
|
(2) Subsection (1) does not apply
|
|
|
|
(a) to a person who incidentally interferes with lawful hunting, trapping, fishing or sport shooting as a result of carrying out a lawful activity such as agriculture, mining or recreation; or
|
|
|
|
(b) to an activity carried out by a person on land that they own or lease.
|
|
|
|
(2) Le paragraphe (1) ne s’applique pas :

|
|
a) à une personne qui entrave la chasse, le piégeage, la pêche ou le tir sportif de façon incidente lors de la pratique d'activités licites telles que l’agriculture, l’extraction minière ou les loisirs;

b) à toute activité exercée par le propriétaire ou le locataire d’un terrain sur celui-ci.

|
|
|
Punishment
|
|
(3) Everyone who commits an offence under subsection (1) is guilty of
|
|
|
|
(a) an indictable offence and liable to a fine of not more than $25,000 or to a term of imprisonment not exceeding one year, or to both; or
|
|
|
|
(b) an offence punishable on summary conviction.
|
|
|
|
(3) Quiconque commet une infraction au paragraphe (1) est coupable :
|
|

|
a) soit d’un acte criminel et passible d’une amende maximale de 25 000 $ et d’un emprisonnement maximal d’un an, ou de l’une de ces peines;
|
|
|
|
b) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire.

|
|
Definition of “sport shooting”
|
|
(4) In this section, “sport shooting” means a formal or informal recreational activity that involves a test of proficiency or skill in the use of a firearm, air gun, archery equipment or any other device that launches a projectile.
|
|
|
|
(4) Au présent article, « tir sportif » s’entend de la pratique — structurée ou non — d’une activité récréative lors de laquelle sont mesurées les compétences ou les habiletés liées à l’utilisation d’une arme à feu, d’un fusil à air comprimé, d’équipement de tir à l’arc ou de tout autre dispositif servant à lancer des projectiles.
