MINUTES OF PROCEEDING
(Meeting No. 8)

Thursday, April 2, 1998

The Standing Joint Committee for the Scrutiny of Regulations met at 8:33 a.m., this day in Room 256-S, Centre Block, the Joint Chairmen, the Honourable Senator Hervieux-Payette and Mr. Derek Lee, presiding.

Representing the Senate: Marisa Ferretti Barth, Normand Grimard, Céline Hervieux-Payette, P.C. William Kelly, P. Derek Lewis, Wilfred P. Moore (6).

Representing the House of Commons: Paul DeVillers, Marlene Jennings, Derek Lee, Ghislain Lebel, Gary Lunn, John Maloney, Gurbax Singh-Malhi, Tom Wappel (8).

In attendance: Suzanne Verville, Joint Clerk of the Committee (House of Commons); François-R. Bernier, General Counsel and Jacques Rousseau, Counsel to the Committee, Research Branch, Library of Parliament.

The committee continued its consideration of its permanent Order of Reference, section 19, The Statutory Instruments Act, R.S.C. 1985, c. S-22, which follows:

19. Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The committee undertook consideration of its proposed budget for the fiscal year 1998-99.

After debate, the Honourable Senator Moore moved --

That the proposed budget in the amount of $212,300 be approved.

The question being put on the motion, it was adopted.

On SOR/88-361 -- Royal Canadian Mounted Police Regulations, 1988 Royal Canadian Mounted Police Regulations;

Mr. Lee read into the record a letter addressed to the Joiont Chairmen of the committee from the Solicitor General.

At 8:55 a.m., it was agreed that the committee continue its sitting in camera.

At 9:05 a.m., the committee resumed its sitting in public.

After debate Mr. De Villers moved --

That the committee invite the Solicitor General to appear before the committee.

The question being on the motion, it was adopted on division.

It was furthermore agreed to ask the Solicitor General to submit a copy of the draft regulations to the committee before his appearance before the committee.

Mr. Lunn moved --

That the committee recommend that the regulations be revoked.

After debate, with the consent of the committee, Mr. Lunn withdrew his motion.

It was agreed, -- That the Joint Chairs correspond with the Minister of Environment with respect to certain comments made by the committee and a copy of the letter be sent to the Minister of Indian Affairs and Northern Development.
