The Standing Joint Committee for the Scrutiny of Regulations met at 8:44 a.m., this day in Room 256-S, Centre Block, Gurmand Grewal presiding.
Representing the Senate: Wilfred Moore (1).
Representing the House of Commons: Gurmant Grewal, Derek Lee, John Maloney, Jacques Saada, Pierrette Venne, Tom Wappel (6).
In attendance: Susan Baldwin, Joint Clerk of the Committee (House of Commons); François-R. Bernier, Peter Bernhardt, Counsel to the Committee, Research Branch, Library of Parliament.
The committee continued its consideration of its permanent Order of Reference, section 19, The Statutory Instruments Act, R.S.C. 1985, c. S-22, which follows:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
Conference on delegated legislation in Australia;
After debate, it was agreed, -- To delegate to the Subcommittee on Agenda and Procedure the authority to select members and determine the arrangements for participation in the conference on delegated legislation in Australia.
Garry Breitkreuz, MP Firearms Act Regulations;
After debate, it was agreed, -- That since Mr. Breitkreuz was unable to appear at today's sitting of the committee, he would be requested to submit further information to the committee respecting his concerns on the Firearms Act Regulations and be invited before the committee when Parliament resumes in the autumn.
On SOR/86-1078 -- Import of Arms Permit;
After debate, Mr. Wappel moved, -- That the Deputy Minister of Revenue Canada be summoned to appear before the Standing Joint Committee for the Scrutiny of Regulations at its first regular meeting in the fall; That a certificate of attendance be issued to that effect as soon as the date of that meeting is ascertained and; That a letter be sent to the Deputy Minister informing him of the committee's decision.
The question being put on the motion, it was adopted with Mr. Lee abstaining.
On SOR/99-26 -- Regulations Amending the Royal Canadian Mounted Police Regulations, 1988;
After debate, Mr. Lee moved, -- That the Commissioner of the R.C.M.P. be invited before the committee and that the committee consider proposing disallowance of the regulations, if necessary, after the Commissioner's appearance.
The question being put on the motion, it was adopted on division with Mr. Wappel opposed.
After debate, it was agreed -- To request answers to all the questions in the letter addressed to the Solicitor General by the Co-chairs on March 24, 1999 before the appearance of the R.C.M.P. Commissioner.
At 10:15 a.m., the committee adjourned to the call of the Chair.
