MINUTES OF PROCEEDINGS

(Meeting No. 4)

 

Thursday, December 4, 1997

 

The Standing Joint Committee for the Scrutiny of Regulations met at 8:35 a.m., this day in Room 257, East Block, the Joint Chairman, Mr. Derek Lee, presiding.

 

Members of the committee present: Representing the Senate: Marisa Ferretti Barth, Normand Grimard, William Kelly, P. Derek Lewis, Rose-Marie Losier-Cool and Wilfred Moore (6).

 

Other Senator present: The Honourable Donald H. Oliver.

 

Representing the House of Commons: Bill Casey, Paul DeVillers, Marlene Jennings, Derek Lee, Gary Lunn, John Maloney, Inky Mark, Alex Shepherd, Caroline St-Hilaire, Tom Wappel and Ted White (11).

 

Other Member present: Gurbax Singh-Malhi.

 

In attendance: Danielle Bélisle, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, Jacques Rousseau and Peggy Rasmussen Jodoin, Counsel to the Committee, Research Branch, Library of Parliament.

 

Also in attendance: The official reporters of the Senate.

 

The committee continued its consideration of its permanent Order of Reference, section 19, The Statutory Instruments Act, R.S.C. 1985, c. S-22, which follows:

 

19. Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

 

Witnesses: From the Treasury Board: Mr. John McBride, Executive Director, Regulatory Affairs. From the Ministry of Environment: Ms Jennifer Moore, Director General, Regulatory and Economic Issues.

 

Mr. Wappel moved: That the minutes and evidence of the committee meetings of November 6 and 20, 1997 be deemed to form part of the records of the committee.

 

The question being put on the motion, it was -- Resolved in the affirmative.

 

Mr. McBride made a statement and answered questions from members of the committee with respect to the Fraser Institute report on Regulatory Impact Analysis Statements.

 

Ms Moore answered questions from the members of the committee.

 

Ms Moore made a commitment to submit a timetable to the committee by January 5, 1998 for providing answers to the files on which the Department has not yet answered the committee's questions.

 

It was agreed, that the next meeting of the committee be held on February 12, 1998.

 

At 10:07 a.m., the committee adjourned to the call of the Chair.
