MINUTES OF PROCEEDING
(Meeting No. 5)

Thursday, February 12, 1998

The Standing Joint Committee for the Scrutiny of Regulations met at 8:37 a.m. this day in Room 256-S, Centre Block, Mr. Derek Lee, presiding.

Members of the committee present:

Representing the Senate: Normand Grimard, Derek Lewis, Léonce Mercier, Wilfred P. Moore.

Representing the House of Commons:, Paul DeVillers, Derek Lee, John Maloney, Ghislain Lebel, Alex Shephered, Tom Wappel, Ted White, Gurbax Singh-Malhi.

Acting member present: Carmen Provenzano for Gurbax Singh-Malhi.

In attendance: Suzanne Verville, Joint Clerk of the Committee (House of Commons); François-R. Bernier, General Counsel and Peter Bernhardt, Counsel to the committee, Research Branch, Library of Parliament.

The committee continued its consideration of its permanent Order of Reference, section 19, The Statutory Instruments Act, R.S.C. 1985, c. S-22, which follows:

19. Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

On SOR/88-361 -- Royal Canadian Mounted Police Regulations, 1988, Mr. Lee, Joint Chairman of the committee, proposed that the committee report the matter to both Houses of Parliament without, however, recommending disallowance. Mr. Lee further recommended that a letter be sent to the Solicitor General indicating that if the regulations in question are not revoked by April 24, 1997, the committee would then recommend disallowance.

After debate, Mr. Lebel moved, -- That the committee adopt the draft report recommending that the regulations be revoked.

After debate, with unanimous consent, Mr. Lebel withdrew his motion and proposed that a new report be drafted which would indicate that the Solicitor General appeared before the committee on April 24, 1997 but with the report still recommending the regulations revoked.

After debate, it was agreed that a new report be drafted for consideration by the committee in which it is mentioned that the Solicitor Genereal appeared before the committee and made a commitment to change the regulations in question.

Furthermore, it was agreed to consider recommending that the regulations in question be revoked if they are not changed without delay.

On SOR/93-75 -- Proceeds of Crime (Money Laundering) Regulations, It was agreed, -- That Counsel to the committee review their status at a later date and inform the committee of the action taken.

On SOR/92-626 Food and Drug Regulations, amendment, It was agreed, -- That the Joint Chairs correspond with the Minister of Agriculture and Agri-food with respect to certain comments made by the committee and also to invite the officials of the Canadian Food Inspection Agency before the committee.
