SOMMAIRE
SUMMARY
Le texte modifie la Loi d’interprétation pour prévoir que les lois fédérales et les règlements maintiennent les droits — ancestraux ou issus de traités — des peuples autochtones reconnus et confirmés par l’article 35 de la Loi constitutionnelle de 1982 et n’y portent pas atteinte. De plus, il modifie ou abroge des dispositions semblables contenues dans d’autres lois et connues sous le nom de dispositions de non-dérogation.
This enactment amends the Interpretation Act to provide that Acts of Parliament and regulations are to be construed as upholding the Aboriginal and treaty rights of Indigenous peoples recognized and affirmed by section 35 of the Constitution Act, 1982, and not as abrogating or derogating from them. It also amends or repeals similar provisions in other Acts known as non-derogation clauses.

38 (1) Subsections (2) to (5) apply if Bill C-49, introduced in the 1st session of the 44th Parliament and entitled An Act to amend the Canada–Newfoundland and Labrador Atlantic Accord Implementation Act and the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act and to make consequential amendments to other Acts (in this section referred to as the “other Act”), receives royal assent.
(2) Si l’article 2 de l’autre loi entre en vigueur avant l’article 8 de la présente loi :
-
a) l’intertitre précédant cet article 8 et les articles 8 et 9 de la présente loi sont réputés ne pas être entrés en vigueur et sont abrogés;
-
