An Act to amend the Canada Elections Act (identity of electors)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. (1) Subsection 143(1) of the Canada Elections Act is replaced by the following:

Elector to declare name with face uncovered

143. (1) Each elector, on arriving at the polling station, shall, with his or her face uncovered, give his or her name and address to the deputy returning officer and the poll clerk, and, on request, to a candidate or his or her representative.

(2) Paragraph 143(2)(b) of the Act is replaced by the following:

(b) if the elector does not possess any piece of identification described in paragraph (a), two pieces of identification authorized by the Chief Electoral Officer each of which establish the elector’s name and at least one of which establishes the elector’s address.

Elector to be given regular ballot

241. An elector who applies to vote in person at the office of the returning officer for his or her electoral district after ballots for the electoral district have been printed shall be given a ballot that is not a special ballot and, after complying with subsection 143(1), shall immediately vote in the manner described in paragraphs 151(1)(a) and (b) and 227(2)(b) to (d) and return the outer envelope to the election officer.

241. Si l'électeur présente en personne sa demande au bureau du directeur du scrutin de sa circonscription après que les bulletins de vote ont été imprimés, un bulletin de vote qui n'est pas un bulletin de vote spécial lui est remis; dans ce cas, il vote sur-le-champ après avoir rempli les conditions mentionnées au paragraphe 143(1) et selon les modalités prévues aux alinéas 151(1)a) et b) et 227(2)b) à d) et remet l'enveloppe extérieure au fonctionnaire électoral.
