SUMMARY
This enactment amends the Canada Elections Act to prohibit any person from transmitting an election advertising message to the public by means of a television or Internet broadcast unless the broadcast contains closed captioning for the hearing impaired.

Le texte modifie la Loi électorale du Canada de façon à interdire la diffusion, au moyen de la télévision ou d’Internet, d’une publicité électorale qui ne comporte pas un sous-titrage codé à l’intention des malentendants.

An Act to amend the Canada Elections Act (closed captioning)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
Loi modifiant la Loi électorale du Canada (sous-titrage codé)
Sa Majesté, sur l'avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :
1. The Canada Elections Act is amended by adding the following after section 325:
1. La Loi électorale du Canada est modifiée par adjonction, après l’article 325, de ce qui suit :
Closed captioning
325.1 No person shall transmit an election advertising message to the public by means of a television broadcast or a broadcast on what is commonly known as the Internet unless it contains closed captioning for the hearing impaired.
325.1 Il est interdit de diffuser, à la télévision ou sur le réseau communément appelé Internet, une publicité électorale qui ne comporte pas un sous-titrage codé à l’intention des malentendants.

2. Section 495 of the Act is amended by adding the following after subsection (2):
2. L’article 495 de la même loi est modifié par adjonction, après le paragraphe (2), de ce qui suit :
Offences requiring intent — summary conviction
(2.1) Every person who wilfully contravenes section 325.1 (closed captioning) is guilty of an offence.
(2.1) Commet une infraction quiconque contrevient volontairement à l’article 325.1 (sous-titrage codé).
