The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:34 a.m. in Room 256-S of the Centre Block, the Joint Chairman, Mr. Paul Szabo, M.P., presiding.

Representing the Senate: The Honourable Senators Bryden, De Bané, P.C., Harb and Moore (4).

Representing the House of Commons: Robert Bouchard, Dean Del Mastro, Paul Dewar, Ken Epp, Derek Lee, John Maloney, Rick Norlock, Paul Szabo and Tom Wappel (9).

Also present: Mike Macpherson, Joint Clerk of the Committee (House of Commons); from the Research Branch of the Library of Parliament: Peter Berhardt, General Counsel, and Jacques Rousseau, Counsel.

Also present: The official reporters of the Senate.

The committee continued to examine its permanent order of reference set out in section 19 of the Statutory Instruments Act, R.S.C. c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

On SOR/2004-263 — Regulations Amending Certain Regulations Made under the Fisheries Act (Miscellaneous Program), it was agreed that committee counsel would write to the statutory instruments officer at Fisheries and Oceans Canada to share some of the committee’s observations.

On SOR/99-294 — Onshore Pipeline Regulations, 1999, it was agreed that committee counsel would examine the file at a later date and apprise the committee of any action taken.

On SOR/2004-70 — Regulations Amending the Members of Committees and Special Committees (NAFTA) Regulations, it was agreed that the file should be closed.

On SOR/2001-536 — Regulations Amending the Consular Services Fees Regulations, I was agreed that committee counsel would write to the statutory instruments officer at Foreign Affairs and International Trade Canada to share some of the committee’s observations.

On SOR/2005-405 — Regulations Amending the Boating Restriction Regulations, it was agreed that committee counsel would write to the statutory instruments officer at Transport Canada to share some of the committee’s observations.

On SOR/89-127 — Food and Drug Regulations, amendment, it was agreed that committee counsel would write to the statutory instruments officer at Foreign Affairs and International Trade Canada to share some of the committee’s observations.

On C.R.C. c. 961 — Indian Timber Regulations, it was agreed that committee counsel would write to the statutory instruments officer at Indian and Northern Affairs Canada to share some of the committee’s observations.

On SOR/2002-222 — Metal Mining Effluent Regulations, it was agreed that the file should be closed.

On C.R.C. c. 1551 — Textile Labelling and Advertising Regulations, it was agreed that committee counsel would write to the statutory instruments officer at the Competition Bureau to share some of the committee’s observations.

On SOR/94-668 — Canada Labour Standards Regulations, amendment, it was agreed that committee counsel would write to the statutory instruments officer at Human Resources and Skills Development Canada to share some of the committee’s observations.

On SOR/2003-289 — Federal Halocarbon Regulations, 2003, it was agreed that committee counsel would examine the file at a later date and apprise the committee of any action taken.
