The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:30 a.m. in room 256-S of the Centre Block, the Joint Chairs, the Honourable J. Trevor Eyton and Mr. Paul Szabo, M.P., presiding.
Representing the Senate: The Honourable Senators Bryden, De Bané, P.C., Eyton, Harb and Moore (5).
Representing the House of Commons: France Bonsant, Ron Cannan, Paul Dewar, Dean Del Mastro, Ken Epp, Rick Norlock and Paul Szabo (7).
Also present: Mike Macpherson, Joint Clerk of the Committee (House of Commons); from the Parliamentary Research Branch of the Library of Parliament: Peter Bernhardt, General Counsel, and Shawn Abel, Counsel.
In attendance: The official reporters of the Senate.
The committee continued to examine its permanent Order of Reference as set out in section 19 of the Statutory Instruments Act, R.S.C. (1985), c. S-22, which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
On SOR/2003-30 — Consular Fees (Specialized Services) Regulations, it was agreed that Committee counsel would examine the file at a later date and keep the Committee apprised of any action taken.
On SOR/2004-149 — Order 2004-87-03-01 Amending the Domestic Substances List, it was agreed that Committee counsel would examine the file at a later date and keep the Committee apprised of any action taken.
On SOR/96-476 — Airport Traffic Regulations, amendments, it was agreed that the Joint Chairs of the Committee would write to the Minister of Transport to pass along some of the Committee's observations.
On SOR/2006-241 — Regulations Amending the Food and Drug Regulations (Data Protection), it was agreed that Committee counsel would write to the statutory instruments officer at Health Canada to pass along some of the Committee's observations.
On SOR/2005-178 — Cigarette Ignition Propensity Regulations, it was agreed that the Joint Chairs of the Committee would write to the Minister of Health to pass along some of the Committee's observations.
On SOR/95-189 — Nova Scotia Offshore Area Petroleum Diving Regulations, it was agreed that Committee counsel would write to the statutory instruments officer at Natural Resources Canada to pass along some of the Committee's observations.
On SOR/95-233 — Saskatchewan Fishery Regulations, 1995, it was agreed that Committee counsel would write to the statutory instruments officer at Fisheries and Oceans Canada to pass along some of the Committee's observations.
On SOR/2001-390 — Form of Proxy (Banks and Bank Holding Companies) Regulations, it was agreed that Committee counsel would write to the statutory instruments officer at Finance Canada to pass along some of the Committee's observations.
On SOR/2001-395 — Investment Limits (Cooperative Credit Associations) Regulations; SOR/2001-396 — Investment Limits (Insurance Holding Companies) Regulations; SOR/2001-397 — Investment Limits (Insurance Holding Companies) Regulations; SOR/95-334 — Newfoundland Offshore Area Petroleum Geophysical Operations Regulations, it was agreed that Committee counsel would write to the statutory instruments officer at the Office of the Superintendent of Financial Institutions to pass along some of the Committee's observations.
On SOR/98-166 — Regulations Amending the Patented Medicines (Notice of Compliance) Regulations, it was agreed that Committee counsel would write to the statutory instruments officer at Natural Resources Canada to pass along some of the Committee's observations.
On SOR/2005-149 — Export and Import of Hazardous Waste and Recyclable Material Regulations, it was agreed that Committee counsel would examine the file at a later date and keep the Committee apprised of any action taken.
The Committee examined SOR/2003-301 — Investments in Associations and Cooperatively-owned Entities Regulations.
The Committee examined SI/2003-173 — Proclamation Giving Notice that the Supplementary Agreement to the Agreement on Social Security between Canada and the Federal Republic of Germany Comes Into Force on December 1, 2003.
On SOR/95-25 — Investment Canada Regulations, amendment, it was agreed that Committee counsel would write to the statutory instruments officer at Industry Canada to pass along some of the Committee's observations.
On SOR/2006-175 — Regulations Amending the Comprehensive Study List Regulations (Miscellaneous Program), it was agreed that Committee counsel would write to the statutory instruments officer at the Canadian Environmental Assessment Agency to pass along some of the Committee's observations.
The Committee examined SOR/2002-237 — Regulations Amending the National Parks Lease and Licence of Occupation Regulations (1991); SOR/2005-32 — Off-Road Compression-Ignition Engine Emission Regulations; SOR/ 2006-94 — Regulations Amending the Motor Vehicle Safety Regulations (Standards 210.1 and 210.2); SOR/2006-104 — Crown Corporations Involved in the Provision of Commercial Loans Environmental Assessment Regulations; SOR/2006-261 — Regulations Amending Certain Regulations Made Under the Canadian Environmental Assessment Act; SOR/2006-136 — Regulations Amending the Migratory Birds Regulations; SOR/2005-198 — Regulations Amending the Migratory Birds Regulations and Other Regulations in consequence; SOR/2006-223 — Regulations Amending Certain Regulations Made under the Canadian Environmental Assessment Act (Miscellaneous Program); SOR/2006-329 — Order Amending Schedule 1 to the Canadian Environmental Protection Act, 1999 (Miscellaneous Program); SOR/2005-46 — Order Adding Toxic Substances to Schedule 1 to the Canadian Environmental Protection Act, 1999).
