The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:39 a.m. in room 256-S of the Centre Block, the Joint Chair, the Honourable Senator J. Trevor Eyton, presiding.
Representing the Senate: The Honourable Senators Bryden, De Bané, P.C., Eyton and Moore (4).
Representing the House of Commons: Robert Bouchard, Ron Cannan, Paul Dewar, Ken Epp, Derek Lee, John Maloney, Paul Szabo, Tom Wappel and Mike Wallace (9).
Other members present: Rick Dykstra, Randy Kamp and David Sweet (3).
Also present: Mike Macpherson, Joint Clerk of the Committee (House of Commons); from the Parliamentary Research Branch of the Library of Parliament: Peter Berhardt, General Counsel and Jacques Rousseau, Counsel.
In attendance: The official reporters of the Senate.
The committee continued to examine its permanent Order of Reference set out in section 19 of the Statutory Instruments Act, R.S.C. (1985) c. S-22 which provides for the following:
Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.
The Joint Clerk representing the House of Commons presided over the election of the Joint Chair.
Kenn Epp moved:
That Paul Szabo be elected Joint Chair of the committee.
The question being put on the motion, it was resolved in the affirmative.
Mike Wallace moved:
That Ken Epp be elected Vice-Chair.
The question being put on the motion, it was resolved in the affirmative.
Paul Szabo moved:
That Paul Dewar be elected Vice-Chair of the committee.
The question being put on the motion, it was resolved in the affirmative.
The Joint Chairs presided over the meeting.
On SOR/97-144 — Broadcasting Licence Fee Regulations, 1997, it was agreed to adopt the draft report and to report back to both Houses.
On C.R.C. c. 1238 — Northwest Territories Reindeer Regulations, it was agreed that the Joint Chairs should write to the Minister of Indian and Northern Affairs and federal spokesperson in dealings with the Métis and Non-Status Indians to share some of the Committee’s observations.
On SOR/89-93 — Ontario Fishery Regulations, 1989, it was agreed that the Joint Chairs should invite the Minister of Fisheries and Oceans to appear before the Committee.
On SOR/2004-180 — Order Amending the Ontario Hog Charges (Interprovincial and Export) Order; SOR/2004- 256 — Order Amending the Ontario Hog Charges (Interprovincial and Export) Order; SOR/2004-303 — Order Amending the Ontario Hog Charges (Interprovincial and Export) Order; and SOR/2005-13 — Order Amending the Ontario Hog Charges (Interprovincial and Export) Order, it was agreed that committee counsel would write to the statutory instruments officer at the National Farm Products Council to share some of the Committee’s observations.
On SOR/2005-121 — Regulations Amending the Regulations Designating Certain Countries for the Purposes of Tariff Item No. 9810.00.00, 1999-1, it agreed that this file could be closed.
On SOR/95-26 — Special Import Measures Regulations, amendment; SOR/2000-138 — Regulations Amending the Special Import Measures Regulations, it was agreed that committee counsel would write to the statutory instruments officer at Finance Canada to share some of the committee’s observations.
On SOR/92-507 — Storage of PCB Material Regulations, it was agreed that committee counsel would write to the statutory instruments officer at Environment Canada to share some of the committee’s observations.
On SOR/2002-164 — National Capital Commission Animal Regulations, it was agreed that committee counsel would write to the statutory instruments officer at the National Capital Commission to share some of the committee’s observations.
On SOR/98-48 — Refund of Duties Regulations, it was agreed that committee counsel would write to the statutory instruments officer at the Canada Border Services Agency to share some of the committee’s observations.
On SOR/2003-289 — Federal Halocarbon Regulations, 2003, it was agreed that committee counsel would write to the statutory instruments officer at Environment Canada to share some of the committee’s observations.
On SOR/2003-307 — Environmental Emergency Regulations, it was agreed that committee counsel would examine the file at a later date and inform the committee of any action taken.
On SI/94-8 — Order Designating the Minister for International Trade as Minister for Purposes of Section 1 to 9 and Parts I and III of the Act, it was agreed to close the file.
On SOR/2003-281 — Regulations Amending the Law List Regulations, it was agreed to close the file.
