SOMMAIRE
Le texte modifie le Code criminel afin de remédier au vol de véhicules à moteur en augmentant la peine minimale d’emprisonnement dans le cas d’une troisième infraction de vol d’un véhicule à moteur ou de toute autre récidive subséquente, en prévoyant qu’une attention particulière doit être accordée au fait que l’infraction a été commise au profit ou sous la direction d’une organisation criminelle, ou en association avec elle, et en limitant la possibilité que la personne déclarée coupable d’une infraction de vol d’un véhicule à moteur fasse l’objet d’une ordonnance de sursis.
SUMMARY
This enactment amends the Criminal Code to address motor vehicle theft by increasing the minimum term of imprisonment in the case of a third or subsequent motor vehicle theft offence, providing that primary consideration must be given to the fact that the offence was committed for the benefit of, at the direction of or in association with a criminal organization and restricting the possibility for a person convicted of a motor vehicle theft offence of being subject to a conditional sentence order.

Préambule
Attendu :
que, depuis 2015, le taux de vol de véhicules à moteur au Canada a augmenté de 34 %;
que, selon l’Association canadienne de financement et de location, en 2023, un véhicule à moteur était volé toutes les six minutes au Canada;
que, à Toronto, le nombre de vols de véhicules à moteur signalés a triplé de 2015 à 2023, dépassant 12 000 par an;
que le vol de véhicules à moteur est de plus en plus le fait d’organisations criminelles, qui exportent les véhicules volés;
que le Parlement reconnaît que le vol de véhicules à moteur est une question d’intérêt national et estime qu’il est prioritaire de le décourager et de le prévenir au Canada,
Preamble
Whereas, since 2015, the rate of motor vehicle theft in Canada has increased by 34%;
Whereas, in 2023, a motor vehicle was stolen every six minutes in Canada according to the Canadian Finance & Leasing Association;
Whereas, in the city of Toronto, the number of reported incidents of motor vehicle theft tripled between 2015 and 2023 to more than 12,000 a year;
Whereas motor vehicle theft is increasingly becoming the domain of criminal organizations, which export the stolen motor vehicles;
And whereas Parliament recognizes that motor vehicle theft is a matter of national concern and considers it a priority to deter and prevent motor vehicle theft in Canada;

2 (1) L’alinéa 333.1(1)a) du Code criminel est remplacé par ce qui suit :

(a) on proceedings by way of indictment, to imprisonment for a term of not more than 10 years, and to a minimum punishment of imprisonment for a term of Début de l'insertion three years Fin de l'insertion in the case of a third or subsequent offence under this subsection; or
(2) L’article 333.1 de la même loi est modifié par adjonction, après le paragraphe (2), de ce qui suit :
