SOMMAIRE

Le texte modifie la Loi sur la santé des animaux pour ériger en infraction le fait de pénétrer, sans autorisation ou excuse légitime, dans un lieu où se trouvent des animaux, lorsque ce fait peut avoir comme conséquence d’exposer les animaux à une maladie ou à une substance toxique susceptible de leur nuire ou de les contaminer.

SUMMARY

This enactment amends the Health of Animals Act to make it an offence to enter, without lawful authority or excuse, a place in which animals are kept if doing so could result in the exposure of the animals to a disease or toxic substance that is capable of affecting or contaminating them.

1 La Loi sur la santé des animaux est modifiée par adjonction, après l’article 9, de ce qui suit :

1 The Health of Animals Act is amended by adding the following after section 9:

9.‍1 Il est interdit, sans autorisation ou excuse légitime, de pénétrer dans un bâtiment ou un enclos où se trouvent des animaux, ou d’y introduire tout animal ou toute chose, tout en sachant que le fait d’y pénétrer ou d’y introduire l’animal ou la chose pourrait avoir comme conséquence d’exposer les animaux à une maladie ou à une substance toxique susceptible de les contaminer ou en ne se souciant pas de ce fait.

9.‍1 No person shall, without lawful authority or excuse, enter a building or other enclosed place in which animals are kept, or take in any animal or thing, knowing that or being reckless as to whether entering such a place or taking in the animal or thing could result in the exposure of the animals to a disease or toxic substance that is capable of affecting or contaminating them.

65 (1) Every person who contravenes any provision of this Act, other than section Début de l'insertion 9.‍1 or Fin de l'insertion 15, or the regulations or who refuses or neglects to perform any duty imposed by or under the Act or the regulations is guilty of

(1.‍1) Tout individu qui contrevient à l’article 9.‍1 commet une infraction et encourt, sur déclaration de culpabilité :

a) par procédure sommaire, une amende maximale de cinquante mille dollars et un emprisonnement maximal de six mois, ou l’une de ces peines;

b) par mise en accusation, une amende maximale de deux cent cinquante mille dollars et un emprisonnement maximal de deux ans, ou l’une de ces peines.

(1.‍1) Every individual who contravenes section 9.‍1 is guilty of

(a) an offence punishable on summary conviction and liable to a fine not exceeding fifty thousand dollars or to imprisonment for a term not exceeding six months, or to both; or

(b) an indictable offence and liable to a fine not exceeding two hundred and fifty thousand dollars or to imprisonment for a term not exceeding two years, or to both.

(1.‍2) Toute personne autre qu’un individu qui contrevient à l’article 9.‍1 commet une infraction et encourt, sur déclaration de culpabilité :

a) par procédure sommaire, une amende maximale de cent mille dollars;

b) par mise en accusation, une amende maximale de cinq cent mille dollars.

(1.‍2) Every person, other than an individual, that contravenes section 9.‍1 is guilty of

(a) an offence punishable on summary conviction and liable to a fine not exceeding one hundred thousand dollars; or

(b) an indictable offence and liable to a fine not exceeding five hundred thousand dollars.
