SOMMAIRE
Le texte modifie la Loi canadienne sur la protection de l’environnement (1999) afin d’interdire l’utilisation d’emballages de produits de consommation à moins qu’ils ne soient faits de matériel recyclable ou compostable.
SUMMARY
This enactment amends the Canadian Environmental Protection Act, 1999, to prohibit the use of consumer product packaging unless it is made of a material that is recyclable or compostable.

Préambule
Attendu :
que les 8 millions de tonnes de déchets plastiques déversés dans les océans chaque année causent de graves dommages environnementaux et écologiques;
que 40 % des plastiques produits sont destinés à l’emballage et représentent 50 % du plastique qui se trouve dans les sites d’enfouissement partout dans le monde;
que, selon les estimations, moins de 11 % des plastiques utilisés au Canada sont recyclés;
que, selon les objectifs de développement durable des Nations Unies, tous les pays doivent réduire considérablement leur production de déchets d’ici 2030 en favorisant la consommation et la production durables;
que, dans le cadre de la Charte sur les plastiques dans les océans du G7, le gouvernement du Canada s’est engagé à réduire les déchets plastiques en faisant en sorte que tous les plastiques utilisés au Canada soient conçus pour être réutilisés et recyclés, et à collaborer avec l’industrie afin d’atteindre une cible de 100 % de produits de plastique recyclables, réutilisables ou récupérables d’ici 2030;
qu’en raison de l’utilisation excessive d’emballages de produits de consommation non recyclables et non compostables, les consommateurs, les municipalités et les organismes de recyclage ont de plus en plus de difficulté à réduire la production de déchets;
qu’au Canada, la gestion des déchets coûte plus de 3 milliards de dollars par année aux municipalités;
que les provinces et l’administration fédérale reconnaissent que le principe de responsabilité élargie des producteurs est un outil important pour réduire les déchets et mettre l’accent sur le recyclage tout au long du cycle de vie d’un produit,
Preamble
Whereas severe environmental and ecological damage is caused by the 8 million tonnes of plastic waste that enters the oceans every year;
Whereas 40% of all plastics are produced for packaging and account for 50% of all plastic in landfills worldwide;
Whereas it is estimated that less than 11% of the plastics used in Canada are recycled;
Whereas the United Nations’ Sustainable Development Goals call on all countries to achieve a substantial reduction in waste generation by 2030 through the promotion of sustainable consumption and production;
Whereas, as part of the G7’s Ocean Plastics Charter, the Government of Canada committed to reducing plastic waste by ensuring that all plastics used in Canada are designed for reuse and recycling and to working with industry towards a goal of 100% recyclable, reusable or recoverable plastics by 2030;
Whereas the excessive use of non-recyclable and non-compostable materials for packaging consumer products makes it increasingly difficult for consumers, municipalities and recycling agencies to reduce waste;
Whereas the annual cost of waste management to municipalities in Canada amounts to over $3 billion;
And whereas the principle of extended producer responsibility has been identified by provinces and the federal government as an important tool to reduce waste and ensure a focus on recycling throughout all stages in the lifecycle of a product;

packaging material means, in relation to a consumer product, the material used to contain, identify and protect it, or to facilitate its use. It includes inner and outer containers and coverings, but does not include packaging used solely for the safe transportation of the product from the manufacturer to the seller. (matériel d’emballage)

137.1 (1) Il est interdit de vendre ou d’offrir en vente un produit de consommation emballé, sauf si son matériel d’emballage figure à l’annexe 7 ou si celui-ci fait l’objet d’une exemption accordée en vertu du paragraphe 137.1(2).

-
(a) set out in Schedule 7; or
-
(b) the subject of an exemption granted under subsection 137.1(2).

(2) Le ministre peut, sur demande, à l’égard d’un produit de consommation, exempter tout matériel d’emballage de l’application de la présente loi s’il est d’avis que, selon le cas :
-
a) le produit de consommation est utilisé à des fins médicales et il n’existe aucun autre matériel d’emballage convenable;
-
b) le matériel d’emballage est essentiel pour assurer la livraison ou le fonctionnement appropriés du produit de consommation;
-
c) l’utilisation de tout autre matériel d’emballage recyclable ou compostable compromettrait l’intégrité ou la qualité du produit de consommation.

(2) On application, the Minister may, in respect of a particular consumer product, exempt any of its packaging material from the application of this Act, if the Minister is of the opinion that
-
(a) the consumer product is used for medical purposes and no suitable alternative packaging material exists;
-
(b) the packaging material is essential to the proper delivery or functioning of the consumer product; or
-
(c) no recyclable or compostable alternative packaging material could be used without compromising the integrity or quality of the consumer product.

137.2 (1) Sur recommandation du ministre faite au titre du paragraphe (2), le gouverneur en conseil peut, par règlement, ajouter à l’annexe 7 un matériel d’emballage autre qu’un plastique non biodégradable.

(2) Après consultation des gouvernements provinciaux, des municipalités et d’intervenants de l’industrie du recyclage, le ministre peut recommander l’ajout d’un matériel d’emballage donné à l’annexe 7 s’il est d’avis qu’un nombre suffisant de collectivités et de municipalités ont accès à des installations pouvant recycler ou composter ce matériel d’emballage.
Fin du bloc inséré(2) After consulting with the provincial and municipal governments and stakeholders in the recycling industry, if the Minister is of the opinion that a sufficient number of communities and municipalities have access to facilities capable of recycling or composting a particular packaging material, he or she may recommend that it be added to Schedule 7.
