SOMMAIRE
Le texte modifie le Code criminel afin d’ériger en infraction le fait d’utiliser, de porter ou d’avoir en sa possession une arme à feu qui a été utilisée lors de la perpétration d’une infraction.
SUMMARY
This enactment amends the Criminal Code to establish an offence for the use, carrying or possession of a firearm that has previously been used in the commission of an offence.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1 Le Code criminel est modifié par adjonction, après l’article 98.1, de ce qui suit :
1 The Criminal Code is amended by adding the following after section 98.1:

98.2 (1) Est coupable d’un acte criminel passible d’un emprisonnement maximal de cinq ans quiconque utilise, porte ou a en sa possession une arme à feu alors qu’il sait ou devrait savoir que celle-ci a été utilisée lors de la perpétration d’une infraction prévue à la présente partie.
Fin du bloc inséré98.2 (1) Every person who uses, carries or possesses a firearm that he or she knows or ought to know was used in the commission of an offence under this Part is guilty of an indictable offence and is liable to imprisonment for a term not exceeding five years.

(2) La peine infligée à une personne pour une infraction prévue au paragraphe (1) est purgée consécutivement à toute autre peine sanctionnant une autre infraction basée sur les mêmes faits et à toute autre peine en cours d’exécution.
Fin du bloc inséré(2) A sentence imposed on a person for an offence under subsection (1) shall be served consecutively to any other punishment imposed on the person for an offence arising out of the same event or series of events and to any other sentence to which the person is subject at the time the sentence is imposed on the person for an offence under that subsection.
