SOMMAIRE
Le texte modifie le Code criminel afin d’ajouter à l’infraction de méfait à l’égard d’un bien religieux le méfait commis à l’égard d’un bien servant à des fins d’enseignement, à la tenue d’activités ou d’événements à caractère administratif, social, culturel ou sportif, ou encore de résidence pour personnes âgées.
SUMMARY
This enactment amends the Criminal Code to add to the offence of mischief relating to religious property the act of mischief in relation to property that is used for educational purposes, for administrative, social, cultural or sports activities or events or as a residence for seniors.

1 (1) Le passage du paragraphe 430(4.1) du Code criminel précédant l’alinéa a) est remplacé par ce qui suit :
1 (1) The portion of subsection 430(4.1) of the Criminal Code before paragraph (a) is replaced by the following:

Mischief relating to religious property, educational institutions, etc.
(4.1) Quiconque, étant motivé par des préjugés ou de la haine fondés sur la religion, la race, la couleur, l’origine nationale ou ethnique, Début de l'insertion l’âge, le sexe, Fin de l'insertion l’orientation sexuelle ou Début de l'insertion la déficience mentale ou physique Fin de l'insertion , commet un méfait à l’égard d’un bien visé à l’un ou l’autre des alinéas (4.101)a) à d), est coupable :
(4.1) Everyone who commits mischief in relation to property described in any of paragraphs (4.101)(a) to (d), if the commission of the mischief is motivated by bias, prejudice or hate based on religion, race, colour, national or ethnic origin, Début de l'insertion age, sex, Fin de l'insertion sexual orientation or Début de l'insertion mental or physical disability Fin de l'insertion ,

(4.101) Pour l’application du paragraphe (4.1), bien s’entend :
a) de tout ou partie d’un bâtiment ou d’une structure servant principalement au culte religieux — notamment une église, une mosquée, une synagogue ou un temple —, d’un objet lié au culte religieux se trouvant dans un tel bâtiment ou une telle structure ou sur le terrain où ceux-ci sont érigés, ou d’un cimetière;
b) de tout ou partie d’un bâtiment ou d’une structure Début de l'insertion utilisés Fin de l'insertion principalement Début de l'insertion par un groupe identifiable, au sens du paragraphe 318(4), comme Fin de l'insertion établissement d’enseignement — notamment une école, une garderie, un collège ou une université —, ou d’un objet lié à un établissement d’enseignement se trouvant dans un tel bâtiment ou une telle structure ou sur le terrain où ceux-ci sont érigés;
c) de tout ou partie d’un bâtiment ou d’une structure servant principalement à la tenue Début de l'insertion , par un groupe identifiable au sens du paragraphe 318(4), Fin de l'insertion d’activités ou d’événements à caractère administratif, social, culturel ou sportif — notamment un hôtel de ville, un centre communautaire, un terrain de jeu ou un aréna —, ou d’un objet lié à une telle activité ou un tel événement se trouvant dans un tel bâtiment ou une telle structure ou sur le terrain où ceux-ci sont érigés;
d) de tout ou partie d’un bâtiment ou d’une structure Début de l'insertion utilisés Fin de l'insertion principalement Début de l'insertion par un groupe identifiable, au sens du paragraphe 318(4), comme Fin de l'insertion résidence pour personnes âgées ou d’un objet lié à une telle résidence se trouvant dans un tel bâtiment ou une telle structure ou sur le terrain où ceux-ci sont érigés.
(4.101) For the purposes of subsection (4.1), property means
(a) a building or structure, or part of a building or structure, that is primarily used for religious worship — including a church, mosque, synagogue or temple —, an object associated with religious worship located in or on the grounds of such a building or structure, or a cemetery;
(b) a building or structure, or part of a building or structure, that is primarily used Début de l'insertion by an identifiable group as defined in subsection 318(4) Fin de l'insertion as an educational institution — including a school, daycare centre, college or university —, or an object associated with that institution located in or on the grounds of such a building or structure;

(d) a building or structure, or part of a building or structure, that is primarily used Début de l'insertion by an identifiable group as defined in subsection 318(4) Fin de l'insertion as a residence for seniors or an object associated with that residence located in or on the grounds of such a building or structure.

2 En cas de sanction du projet de loi C-16, déposé au cours de la 1re session de la 42e législature et intitulé Loi modifiant la Loi canadienne sur les droits de la personne et le Code criminel, dès le premier jour où l’article 3 de cette loi et l’article 1 de la présente loi sont tous deux en vigueur, le passage du paragraphe 430(4.1) du Code criminel précédant l’alinéa a) est remplacé par ce qui suit :
