SUMMARY
This enactment authorizes a court that sentences or discharges an offender who has committed an offence in respect of a person under the age of sixteen years to prohibit the offender from being in the presence of such a person.
SOMMAIRE
Le texte permet au tribunal qui condamne à une peine ou absout l'auteur d'une infraction commise contre une personne âgée de moins de seize ans d'interdire à celui-ci de se trouver en présence d'une telle personne.

Her Majesty, by and with the advice and consent of the Senate and the House of Commons of Canada, enacts as follows:
Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :
L.R., ch. C-46
1. Subsection 161(1) of the Criminal Code is amended by striking out “or” at the end of paragraph (b), by adding “or” at the end of paragraph (c) and by adding the following after paragraph (c):
1. Le paragraphe 161(1) du Code criminel est modifié par l’adjonction, après l’alinéa c), de ce qui suit :
(d) being in the presence, whether alone or with any other person or group of persons designated by the court, of a person under the age of 16 years except fortuitously or fleetingly and otherwise than in a manner provided for by the court.
d) de se trouver, seul ou avec toute autre personne ou groupe de personnes désignées par le tribunal, en présence d'une personne âgée de moins de seize ans autrement que de manière fortuite ou passagère et autrement que de la manière prévue par le tribunal.
