SUMMARY
This enactment amends the Divorce Act to replace the concept of “custody orders” with that of “parenting orders”. It instructs judges, when making a parenting order, to apply the principle of equal parenting unless if it is established that the best interests of the child would be substantially enhanced by allocating parental responsibility other than equally.

SOMMAIRE
Le texte modifie la Loi sur le divorce afin de remplacer la notion d’« ordonnance de garde » par celle d’« ordonnance parentale ». Il exige du juge, lorsqu’il rend une ordonnance parentale, qu'il applique le principe du partage égal de la responsabilité parentale, sauf s’il est démontré qu’une répartition différente de la responsabilité parentale favoriserait grandement l’intérêt de l’enfant.
