Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The definition “self-employed earnings” in subsection 2(1) of the Canada Pension Plan is replaced by the following:
|
|

2. The Act is amended by adding the following after section 14.1:

14.2 Notwithstanding section 14, a person who has fulfilled not less than five years’ service with a prescribed force of police officers or firefighters, and who retires from that service on attaining an age of not less than fifty years, may, for any year commencing the year of attaining the age of fifty-six years until the year of attaining the age of sixty years, elect to be deemed to be self-employed for all or a part of the year for the purposes of sections 13 and 14 and to continue to make contributions, subject to the other provisions of this Act respecting the maximum contributions permitted, on the basis of self-employed earnings that are the sum of
|

|
|
(a) any contributory self-employed earnings the person may have from actual self-employment; and
|
|
|
|
(b) an amount not exceeding the amount of salary or wages received by the person in the last twelve months of service as a police officer or firefighter.
|
|
|
|
14.2 Malgré l’article 14, une personne qui compte au moins cinq ans de service dans un corps de police ou de pompiers prévu par règlement et qui prend sa retraite de ce service après avoir atteint l’âge de cinquante ans peut, pour toute année à compter de l’année où elle atteint l’âge de cinquante-six ans jusqu’à celle où elle atteint l’âge de soixante ans, choisir d’être réputée avoir exécuté un travail pour son propre compte pour tout ou partie de l’année, pour l’application des articles 13 et 14, et de continuer à verser des cotisations, sous réserve des autres dispositions de la présente loi relatives aux cotisations maximales permises, en fonction de gains provenant d’un travail qu’une personne exécute pour son propre compte consistant en la somme :

a) des gains cotisables provenant du travail que la personne a réellement exécuté pour son propre compte;
|
|
|
|
b) du montant non supérieur au salaire ou traitement que la personne a touché au cours de ses douze derniers mois de service à titre d’agent de police ou de pompier.

3. The Act is amended by adding the following after section 44:

44.1 In the case of a contributor who has fulfilled not less than five years’ service with a prescribed force of police officers or firefighters and who retires from that service on attaining an age of not less than fifty years, the word “sixty-five” in section 44 shall be read as “sixty” and the word “sixty” in that section shall be read as “fifty-five”.

4. Section 46 of the Act is amended by adding the following after subsection (6):
