SOMMAIRE
Le texte modifie la Loi sur la défense nationale afin de retirer certaines infractions d’ordre sexuel commises au Canada du ressort du système de justice militaire.
SUMMARY
This enactment amends the National Defence Act in order to remove certain sexual offences committed in Canada from the jurisdiction of the military justice system.

1 L’article 130 de la Loi sur la défense nationale est modifié par adjonction, après le paragraphe (1), de ce qui suit :
1 Section 130 of the National Defence Act is amended by adding the following after subsection (1):
Exception — infractions d’ordre sexuel
Exception — sexual offences
(1.1) L’alinéa (1)a) ne s’applique pas à une infraction prévue à l’une ou l’autre des dispositions du Code criminel suivantes :
a) les dispositions visées aux alinéas a), c), c.1), d) ou d.1) de la définition de infraction désignée au paragraphe 490.011(1);
b) l’article 463, dans le cas d’une tentative en vue de commettre une infraction visée à l’alinéa a);
c) l’article 465, dans le cas d’un complot en vue de commettre une infraction visée à l’alinéa a).
End of inserted block(1.1) Paragraph (1)(a) does not apply in respect of an offence under any of the following provisions of the Criminal Code:
(a) provisions referred to in paragraph (a), (c), (c.1), (d) or (d.1) of the definition designated offence in subsection 490.011(1);
(b) section 463, in the case of an attempt to commit an offence referred to in paragraph (a);
(c) section 465, in the case of a conspiracy to commit an offence referred to in paragraph (a).

2 La Loi sur la défense nationale, dans sa version antérieure à la date d’entrée en vigueur de la présente loi, continue de s’appliquer à toute poursuite pour infraction d’ordre sexuel visée à l’article 1 qui a été engagée sous le régime de cette loi et sur laquelle il n’a pas été définitivement statué avant cette date.
2 The National Defence Act, as it read immediately before the day on which this Act comes into force, continues to apply to any proceeding in respect of a sexual offence referred to in section 1 that was commenced under that Act and was not finally disposed of before that day.
