SUMMARY
This enactment amends the National Defence Act in order to remove certain sexual offences committed in Canada from the jurisdiction of the military justice system.

An Act to amend the National Defence Act (sexual offences) |
His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

National Defence Act
1 Section 130 of the National Defence Act is amended by adding the following after subsection (1):
Exception — sexual offences
Start of inserted block(1.1) Paragraph (1)(a) does not apply in respect of an offence under any of the following provisions of the Criminal Code:

(a) provisions referred to in paragraph (a), (c), (c.1), (d) or (d.1) of the definition designated offence in subsection 490.011(1);

(b) section 463, in the case of an attempt to commit an offence referred to in paragraph (a);

(c) section 465, in the case of a conspiracy to commit an offence referred to in paragraph (a).

Transitional Provision
Pending proceedings
2 The National Defence Act, as it read immediately before the day on which this Act comes into force, continues to apply to any proceeding in respect of a sexual offence referred to in section 1 that was commenced under that Act and was not finally disposed of before that day.
Coming into Force
First anniversary
3 This Act comes into force on the first anniversary of the day on which it receives royal assent.
