An Act to prevent the imposition by the federal government of vaccination mandates for employment and travel

SUMMARY

This enactment amends the Financial Administration Act to provide that the Treasury Board may not require as a condition of employment in the federal public administration that a person receive a vaccine against COVID-19. It also amends the Canada Labour Code to provide that regulations may not be made that require, as a term or condition of employment in or in connection with the operation of a federal work, undertaking or business, that a person receive a vaccine against COVID-19.

In addition, the enactment amends the Aeronautics Act, the Railway Safety Act and the Canada Shipping Act, 2001 to provide that no regulation, order or other instrument made under any of those Acts to prevent the introduction or spread of COVID-19 may prohibit or have the effect of prohibiting a person from boarding an aircraft, a train or a vessel solely on the ground that they have not received a vaccine against that disease.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Short Title

Short title

1This Act may be cited as the Prevention of Government-imposed Vaccination Mandates Act.

Financial Administration Act

2Subsection 11.‍1(2) of the Financial Administration Act is amended by striking out “and” at the end of paragraph (a) and by adding the following after that paragraph:

  • Start of inserted block

    (a.‍1)do not include the power to require as a term or condition of employment in the federal public administration that a person receive a vaccine against the coronavirus disease 2019 (COVID-19) or to provide for the termination of an employee, or for a suspension of or a reduction in their pay, solely on the ground that they have not received a vaccine against COVID-19; and

Canada Labour Code

3Section 157 of the Canada Labour Code is amended by adding the following after subsection (1.‍1):

Limitation — COVID-19

(2)No regulation may be made under this Part that requires, as a term or condition of employment in or in connection with the operation of a federal work, undertaking or business, that a person receive a vaccine against the coro­navirus disease 2019 (COVID-19).

Aeronautics Act

4The Aeronautics Act is amended by adding the following after section 4.‍74:

Limitation — COVID-19

4.‍741No regulation, notice, order, security measure or emergency direction made under this Part to prevent the introduction or spread of the coronavirus disease 2019 (COVID-19) may prohibit or have the effect of prohibiting a person from entering an aircraft on the sole ground that they have not received a vaccine against that disease.

Railway Safety Act

5The Railway Safety Act is amended by adding the following after section 47.‍2:

Limitation — COVID-19

47.‍21No regulation, order, emergency directive or other instrument made under this Act to prevent the introduction or spread of the coronavirus disease 2019 (COVID-19) may prohibit or have the effect of prohibiting a person from boarding railway equipment on the sole ground that they have not received a vaccine against that disease.

Canada Shipping Act, 2001

6Section 120 of the Canada Shipping Act, 2001 is amended by adding the following after subsection (1):

Limitation — COVID-19

(1.‍1)No regulation made under this section to prevent the introduction or spread of the coronavirus disease 2019 (COVID-19) may prohibit or have the effect of prohibiting a person from boarding a vessel on the sole ground that they have not received a vaccine against that disease.‍

7Section 136 of the Act is amended by adding the following after subsection (1):

(1.‍1)No regulation made under this section to prevent the introduction or spread of the coronavirus disease 2019 (COVID-19) may prohibit or have the effect of prohibiting a person from boarding a vessel on the sole ground that they have not received a vaccine against that disease.‍
